Unless the father is in jail for assaulting the child or child abuse, chances are if you did not attempt to take advantage of the situation the court would have more respect for you.

A "custody battle" can only happen between two equally fit parents. Sounds as though it may not be a contest, if he has criminal charges - if you don't.

I would imagine that most or all of the evidence that you have a criminal charge pending against you is inadmissible as hearsay. It is not hard for a good attorney to overcome that particular hearsay objection, though.

If I were you, I'd go take a court-admissible 10-panel nail test, get a business records affidavit to cover it, and file it with the court. All of us know that urine and hair tests are easy to defeat. Nail tests are much harder to defeat and have a much longer look-back time. A clean nail test, covered with a business records affidavit, is powerful evidence that you were not USING. It's not proof that you were or weren't manufacturing, delivering, selling, etc. I'm not sure what the criminal charges are...don't know if this is helpful or not.

You say that you married a foreigner yet she's denying your permanent visa? If she is the foreign national and not you, why do you have a visa issue? It sounds like you should hire an attorney and file for divorce ASAP to stop the financial bleeding.

If your wife has had the conditions on her temporary permanent status removed with your assistance already, I am afraid there is not much to be done to reverse that.

Up until last year, you could do nothing. However, Florida has allowed people with permanent suspensions to be able to get an employment purpose only license. You still have to follow strict requirements and you must continually maintain treatment programs, but you would at least be eligible to apply with DMV. Once you get a hardship, it will be easier to transfer to another state and get a hardship in that state (most of the time, but it depends on the new state).

However, be very careful how the re- transfer of the house will effect the Medicaid prohibition and disqualification of your father from continuing to receive the same - Holding a home in a revocable living trust is a prohibition of Medicaid rights; you had best ask qualified legal counsel who specializes in Elder Law or at least convey it back to a "ladybird" deed so that your parent holds it in their individual name even though the trust could be used to pay the upkeep at that time. The Lady Bird deed could have it pass either into the trust upon parent's death, or directly to the heirs avoiding the trust and probate.

Due to the fact that the home is same value as when originally conveyed there would be no benefit in re conveying to get an income tax break since there would be no available "step up" in tax basis upon an eventual sale. Also for any capital gain tax break to be taken the transfer to the parent would have to be more than 1 years prior to their death. You would not recover the past realty taxes and upkeep you have expended on the same. Only if the home would again qualify as the possessed homestead of your parent would there be any protection from the parent's creditors upon their eventual death, but this certainly would not overide inherent Medicaid dangers set forth above, since those loses would be extensive the longer the parent would remain alive after qualification.

The agent, the broker in charge and the owner of the agency have not responded to any e-mails and phone calls other than one e-mail to say that the owner asked the agent for a copy of the contract. The owner has not responded since then. We even asked for the contract to be reduced to 6 months as a sing of good faith to show that we are not using another real estate firm. We do not live in NC and it is over a 14 hour drive to get there. What can my wife and I do other than wait out the contract?

These contracts are pretty speculative in terms of duration. That is why the broker could not give you a definite time. Just send them written notice that you cancel the agreement and then you can go with another broker. Just make sure you inform the other broker that you recently fired someone.

If you are upset about the term in the contract but otherwise like the broker, you should speak to them about this. They probably added the 1 year term as a way to appease you. Most broker agreements, especially for buyers are pretty much terminable at will by the buyer

I can't give you a 100% certain answer, because I don't know every law affecting every kind of business. Nevertheless, I'd say the chance that taking deposits to hold dates is downright illegal, in the sense that some statute makes it an infraction or even a misdemeanor to do so, is about 1 in 1,000. In addition to this statement, however, I should point out that the law disfavors penalties in private contracts, based on the theory that it is the court's role, not the parties', to determine the damages for a breach of contract. Hence, some limitations are placed upon the parties' capacity to pre-set the forfeiture or penalty for a breach. If the penalty is excessive, that part of the contract will be unenforceable. Generally, a deposit forfeiture that is a reasonable 'a priori' guesstimate of a party's likely harm done by a breach by the other party will be upheld; if it looks like too much to the judge, you'd either get nothing at all or be limited to damages you could actually prove by admissible evidence.

So, you might want to put language in your agreement saying, "The parties agree that $50 is a reasonable estimate of Party A's loss if Party B cancels early, and that amount will not be refundable." or words to that effect.

May I suggest you try networking with others who are in the same business, but sufficiently far away that you aren't competitors? You can probably both teach and learn a lot about your business by communicating with other play center owners who are 50+ miles away but in California.

Think about the application and any non-refundable fees. If you had a house under contract and lost out, you need to have an attorney review that situation as well. Your only other option if you've lost the house and the loan hasn't been approved, start over. Find a house, work with a broker, hire an attorney, work with a mortgage lender that has a good track record.

You should check with the court to see if it has been dismissed, if not, the court is expecting someone to file a judgment package if you've reached a settlement agreement. I sold a restaurant/bar in MN last year. They remodeled, changed the name and chagned the concept of the business that I sold to them. The balance was to be paid to me over 5 years. I have a promissory note and personal guarantee from the buyers for the remaining $100k that is owed to me and have a UCC filing on all of the business equipment. They have been in default since October of 2012 and I am currently suing them for breach of contract to collect the balance due. They are countering by alleging that I misrepresented the financial information during their due diligence process. I did no such thing. I am still a guarantor on the lease, so I have every reason to make sure they are successful. I have an attorney, who is a friend of mine, but I'm not sure he has the expertise in this area that I need. I do have a criminal past that they are trying to use against me in this case and my lawyer warns that a jury may hear that stuff and make their decision based on it and not the facts of this case. There is a minimal offer from them to end this lawsuit and my lawyer is advising me to take it to avoid any negative things at trial. I understand the risk versus reward but do not think I should give in to a low offer just because they are threatening to bring up my past. They have since sold the business to another party without my knowledge, approval or paying off my note.

My questions are as follows:

1. Can they claim misrepresentation of the numbers if they went away from my business model that was working for me? They have failed and are looking for a way out of the contract.

The school psychologist tried to forcibly diagnosis me with borderline disorder after my test, claiming i couldn't have asperger's syndrome because i was too intelligent even though a above level intelligence is one of the indicators of Asperger's syndrome. She violated HIPPA by calling her friend who worked at the local hospital's mental ward and told her to expect me to arrive there and that i was borderline disorder. After that, she contacted my parents and told them that if they didn't place me at this mental ward she would have the school force them to put me in. My parents put me in the ward under her threats, even though i was already under the care of a psychiatrist. I was checked in by the nurse friend of the school psychologist who had already been contacted by the school psychologist and led to believe i was borderline rather than what i really was. After i finally got out after five days, the school still refused to accept my diagnosis as being Asperger's syndrome and ADHD and refused to pay for a reevaluation. With help from my advocate we did have another evaluation done, with a doctor of the school psychologist choice, and the doctor came back saying that i was asperger's syndrome and ADHD and if my grades continued to fall or i end up back in the metal institute because of the school not providing me with the help i needed, the doctor would hold the school personally responsible for whatever happened to me. I switched schools to get the help i needed, not wanting to stay at the school that put my parents and me through hell. We were too shocked at the time to press charges and over the years my mother has found that i wasn't the first or last child that school psychologist did that too. Me and other of her victims are now considering making a accusation against her, something i feel like i ought to do since learning that she's still working with children at the same exact school. I want to know what are our chances and just what can she be charged with? If nothing else, i'd like her license revoked so that she can not continue doing what she did to me.

The time limit is three years, so your time to file ran out on your 21st birthday unless you were mentally or emotionally disabled. Therefore, I'd say San Diego County is one that doesn't have a special deadline for serving papers following the granting of a hearing date and time by the clerk.

However, the motion still needs to be served and filed within the time prescribed by law, usually per section 1005(b) of the Code of Civil Procedure, which specifies 16 court days beforehand, with increases depending upon service method and distance.

Finally, if you are inexperienced in law and motion practice, note that most California courts are so backlogged that you'll be lucky to get a motion hearing date that isn't at least a month after you make your request.

The Judge awarded the mother with 60% custody and primary residential parent, and awarded child support. The mother is unstable, and has moved 6 times since the filing date, and my daughter missed 32 days of unexcused absences, and changed schools 3 times her kindergarden year. At the Final Judgment hearing the Judge ordered that if my daughter missed more than 5 days unexcused, that would be means for substantial change in circumstances. To add to it the mother of my daughter, was with a boyfriend who assaulted the mother while all 3 of her children were in the home, then moved to the home of the father of her 2 younger children. On the 29th of December the mother and him got into a bad argument, she left with all 3 children, and he committed suicide. I filed a motion for a 1 hour hearing, due to the change in circumstaces, and the mother's failure to follow the Judge's order, and I was denied. Now Iknow that this Judge is does not have my daughter's best intrest at heart. I asked for a divorce and actually started the proceedings in 2008 but didnt finish as he was threatening to kill himself if i served him. In answer to your question, if the father has had no contact with his children for 5 years and he "signed his rights over to you" and he has been in rehab, I see no reason that you should have to worry that he would be able to 'take the kids from you" or that he would get anything more than supervised visits with the kids if he ever wanted to see them again at all. I've been married for 8 months and for at least 6, it's been broken down irretrievably. I'm from UK and my wife is from New York, we got married in New York. We have no children or property together. We're currently in the process of me getting a VISA which I plan to cancel as soon as possible. My question is, would we be able to get an uncontested divorce without me having to go there? From what I've read, one person needs to vouch that the marriage has irretrievably broken down- if I filled out the forms and sent them to her, would she be able to do this without me traveling back to New York? Or alternatively would I be able to do it in UK? We have both agreed to an uncontested divorce, it's just a matter now of figuring out the process and what's the easiest way to do it.

If she is a New York resident and has been one for at least one year you can get divorced here without ever coming here. The only hurdle you'll have to overcome is to have your signature on some documents notarized by a U.S. notary. This can be accomplished at a U.S. Consulate in the UK or at some large law firms where they have attorneys who are from the United States and who became notaries prior to going to work in the UK.

You may wish to have the divorce paperwork done by an attorney here in New York.

We ended up having to call their corporate office to try to resolve the matter. They finally call and want to fix it. They are offering three options. Option one is to dealer endorse a new loan on a vehicle within the price range of the original loan we were already approved for. Option two is to have us turn over our car to them since they have the title and split the negative equity with them. This will cost me around 2,000.00. Option three is to return the title to our finance company and let our account be in rears and appear on our credit. I don't feel that their options are that helpful. I have only included very breif details. We have been lied to repeaditly, called a liar, spent money re-tagging and stickering the car, and have to pay the bank back or a check that the finance company refunded a payment we sent and then they cancelled the check. We have tried working with the finance company, the dealership, their corporate office, the BBB, and LES to get this situation resolved. We live in Virginia and the dealership is in Tennessee. I hope you can advise me on what to do because I am getting so much mixed information.

If I had the police report I could probably advise you. I'm assuming you do not have an attorney. You really should talk with one. Its possible that the prosecutor is thinking you were on some sort of drug. Alcohol is not the only substance that applies to a DUI. Any substance that can impair a person's ability to drive qualifies under the statute. If you cannot afford an attorney, see if you can get a consultation with one. You aren't required to do anything; but that just means the parties can't agree to a settlement and the case proceeds toward a trial. I've never recommended to anyone on Law Guru to get an attorney as urgently as I am now. Clearly you mean an "Affidavit of Confession." Seeing as you don't even know what that means, spend the three hundred dollars or so to have an attorney review your Settlement Agreement unless you're content with potentially screwing yourself. If the case is in court already, an Affidavit isn't required because there is CPLR rule which obviates the need for it; so it sounds like the other side's lawyer isn't so sharp or experienced.
