I want to divorce my husband. He is not so much for the divorce. He isn't here very often as he works a lot of hours, more than his mandatory 8.5 hour day. We have 2 children, one with special emotional needs. I have worked part time to be able to take care of our children for the past 6 years. We own a home and 2 cars. The cars are both paid in full. He doesn't want to pay child support, and he wants to keep the house, since I'm the one who wants to leave. We have been in the house for almost 10 years. My issue is I can't support the kids on my own with my current job, and I want some of the equity out of the house so I can start my life over. I don't want the divorce to be messy because of the kids. I know that is kind of an oxymoron, but I want this to be as easy on them as possible. How do I go about a divorce that I can afford, and not lose out on all the things I have helped to work for?

1. Find a trusted friend or relative to come over and stay at your house for a few hours.

2. Unscrew the doorknobs off the doors and take them to Home Depot (or Lowe's). Tell the helpful employee that you want to re-key the locks. He'll sell you the new lock guts and will install them for you. It will cost less than $75.

3. Get extra copies of the new door keys before you leave.

4. Go home and put the doorknobs back in.

5. Throw away the old door keys so as to prevent confusion.

6. Write your wife a letter (paper letter - on emails or text messages) and tell her what you've done. Tell her not to try to break in. Date the letter. Keep a copy or two.

Before we can fully understand how the ignition system on your car functions, we need to brush up on the basics of internal combustion.
Your engine is like a big pump. It pumps air and gas in, then pumps exhaust out. The byproduct is a lot of energy that is sent to your wheels (and exhaust out the tailpipe. That's the basic of all basic descriptions. A little detail helps complete the picture. Your engine mixes air and fuel, then adds a spark to make the explosion. This spark ignites the air-fuel mixture, and is referred to as the ignition.
This ignition takes place thanks to a group of components working together, otherwise known as the ignition system. The ignition system consists of an ignition coil, distributor, distributor cap, rotor, plug wires and spark plugs. Older systems used a points-and-condenser system in the distributor, newer (as in most we'll ever see anymore) use an ECU, a little brain in a box, to control the spark and make slight changes in ignition timing. What do all of these components do? We'll explain.

The ignition coil is the unit that takes your relatively weak battery power and turns it into a spark powerful enough to ignite fuel vapor. Inside a a traditional ignition coil are two coils of wire on top of each other. These coils are called windings. One winding is called the primary winding, the other is the secondary. The primary winding gets the juice together to make a spark and the secondary sends it out the door to the distributor.You'll see three contacts on an ignition coil, unless it has an external plug, in which case the contacts are hidden inside the case. The large contact in the middle is where the coil wire goes (the wire that links the coil to the distributor cap. There is also a 12V+ wire that connects to a positive power source. The third contact communicates information to the rest of the car, like the tachometer.Once the coil generates that very powerful spark, it needs to send it someplace. That someplace takes the spark and sends it out to the spark plugs, and that someplace is the distributor.The distributor is basically a very precise spinner. As it spins, it distributes the sparks to the individual spark plugs at exactly the right time. It distributes the sparks by taking the powerful spark that came in via the coil wire and sending it through a spinning electrical contact known as the rotor. The rotor spins because it's connected directly to the shaft of the distributor. As the rotor spins, it makes contact with a number of points (4, 6, 8 or 12 depending on how many cylinders your engine has) and sends the spark through that point to the plug wire on the other end. Modern distributors have electronic assistance that can do things like alter the ignition timing.After the coil takes the weaker juice and makes a high powered spark, and the distributor takes the powerful spark and spins it to the right outlet, we need a way to take the spark to the spark plug. This is done through the spark plug wires. Each contact point on the distributor cap is connected to a plug wire that takes the spark to the spark plug.The spark plugs are screwed into the cylinder head, which means that the end of the plug is sitting at the top of the cylinder where the action happen. At just the right time (thanks to the distributor), when the intake valves have let the right amount of fuel vapor and air into the cylinder, the spark plug makes a nice, blue, hot spark that ignites the mixture and creates combustion.At this point, the ignition system has done its job, a job it can do thousands of times per minute.In the old days, a distributor relied on a lot of its own "mechanical intuition" to keep the spark timed perfectly. It did this through a setup called a points-and-condenser system. Ignition points were set to a specific gap that created optimum spark while the condenser regulated.These days this is all handled by computers. The computer that directly regulates your ignition system is called the ignition module, or ignition control module. There is no maintenance or repair procedure for the module, other than replacement.

My house was built in 1920 and was rehabed when i moved in. In the situation that you describe, the usual first step is for your lawyer to write to the contractor and demand assurances that the contract will be performed. I would also verify the registration status because you may be able to avoid the contract if the contractor is not registered. Eat the popcorn, and when you find unpopped corn kernels, shoot them at the balloons with the slingshot. Fun thing to do if you're watching a movie on a TV channel during the commercials.

If you are the landlord or tenant and the Ordinance does NOT apply to your building, there are several Illinois laws that may still apply.

That is extortion to threaten with bodily harm. The owner can report it but the DA will determine if there is enough evidence to prosecute. Based on those facts I wouldn't worry as it looks pretty ugly for the owner not to report it right away and then try to extort her.

First off, is it has been through foreclosure, then she couldn't be doing a short sale. So you clearly don't even know what the actual situation is. Second, as long as she owns the house, you owe her rent. Period. If she sells or loses the house, you will owe the new owner rent and will probably have to move within anywhere from 30-90 days after the change of ownership, unless you have a lease that will not run out until longer than that.

If the landlord mailed you an eviction notice, it means that they believe you either are behind on rent or otherwise violated the lease agreement, or the lease has expired, and they no longer want to rent to you. A letter for the landlord does not mean that the deputies will be right out to put your family on the street, and courts don't mail eviction notices. The letter from teh landlord means that if you do not get the matter strainghtend out with the landlord, they will file suit to try and obtain a judgment against you. If they get that judgment, then they can ask the deputies to come out. If you have not gotten it straightened out with the landlord, you might consider moving or speaking directly with an attorney in your area. Many offer a free or low cost initial consultation. If the "eviction letter" was from the court, it was a Petition and Summons, in whcih case youdo nee dot move or speadk direclty with counsel. Or, there already is a judgment for possession, and the letter is letting you know that the deputies are coming.

Technically when you signed over the tittle you gave him the vehicle. You may have an enforceable verbal contract. Yes you can sue to recover the costs of the car as it is probably a small claims amount. Because we thought the transaction would be complex and require ongoing negotiations, modifications, and knowledge of the local real estate market, we asked the seller to pay a 3% commission to the agent/agency. WE negotiated the contract (we are attys.) and once the purchase contract was signed, neither we or the seller's agent were unable to get any response to our emails and phone calls from the agent or agency. We were quite simply, abandoned. Aside from filing a complaint w/ the MD Real Estate Commission, what is our legal recourse? Do we have a claim for breach of contract or unjust enrichment? $21,000 is a lot of money to pay for nothing.

Probably depends on the exact wording of the listing agreement for starters -- and they're usually worded tightly to prevent home buyer/owners from gaming things by claiming it was really a DIY transaction at some point. Typically, the law otherwise requires that a sales person be the "procuring cause" of the contract.

I think if you can prove that the agent/broker was asked but failed to: (1) identify and locate the subject property; (2) negotiate the agreement; (3) participate in prep for settlement etc -- that you have at least a colorable case for breach of contract -- with the damages being the amount of the commission.

I don't think "unjust enrichment' fits --- that's a quasi-contract remedy useful for when there ISN'T a written contract to rely upon .

It takes a court order to change who the listed father is on a birth certificate. That requires a paternity action, and you may not like the results, because the court may find that your husband is the father of this child, and not biological father, due to application of legal policies. The worst thing you can do when on probation is to not report. People don't get jailed for being too poor to pay. They do get jailed for not reporting. You need a lawyer now. You have a very good possibility of jail.

My husband and his attorney are pushing me to accept a settlement of close to nothing, and I have refused.

My husbands attorney went to the judge exparte, and got my support stopped. I do not see any grounds for it to be stopped, it is sort of thrown in as the last sentence in a motion. I was not notified by the courts or his attorney that this was filed.

I went to see the judge yesterday to file my own exparte motion to get it reinstated. He refused to see me.

In Ohio, ex parte communication with the judge is not allowed except in certain enumerated (usually emergency or highly temporary circumstances a short time after which a full blown hearing is held on the issue).

What may have happened was that there was a hearing that perhaps you were not told about (perhaps the notice of it went to your former attorney's office and he/she assumed that you were sent a notice of that hearing as well) and when no one showed up for the hearing from your side, the judge granted them what they wanted. That is just a theory on my part though.

You should pick up a new attorney as soon as possible to protect your rights in this matter.

I work in the medical field as a certified surgical assistant. I am compensated from insurance companies. There is one insurance company that will mail any money due to me for my services directly to the patient (normally other insurance companies will just mail a check directly to me). The patient in return is to mail me a payment. My billing service notifies the patient in advance of this and explains what is to be done when they receive payment for my services. A few years ago I started using a collection agency as many of the patients for what ever reason were not sending me a payment after receiving a check from the insurance company. After numerous attempts on my billing services part to obtain my payment, it is then sent to collections. At end of last year the collection agency I used had gotten a payment from one of these patients. The amount collected was $581.04. After the collections fee I was mailed a check for $377.68. A few months later the insurance company said that they had made a mistake and no payment should of ever been sent to me and is demanding the full amount of $581.04 back. I sent a letter back to insurance company telling them that I only got $377.68 from the collection agency and to check to see that it was not a mistake and the payment was meant for me. Two months later I was sent notice stating that this matter was sent to collections.

My question to you is where do I stand on this? Am I obligated to send back any money collected on this even thought no payment was ever directly sent to me from the insurance company as it went directly to the patient? Also I did not receive the full $581.04.

Short answer is yes... if there was a billing error or payment error... you are responsible for the full amount for repayment... you should go after your collections company for the amount they held back for their payment. Your relationship with the collections agency is separate from your relationship with the insurance company and patient.

The guy never gave me the name of the company in which he works, also stated that he was not a debt collector, rather he was a clerk and then he transferred me over to the "head of legal" in which the "head of legal" told me he was going to have me prosecuted for a bad check, he told me that if I paid the "restitution" amount of $596 (Which the original check amount was $296 after all fees) and told me if I sent in the payment in person at a certified money grahm place before noon they would drop the "charges" otherwise it would be filled and sent over to the commonwealth of KY for procecution.

The question that lies in my head is this, in the state of Ky, a post dated check, such as the kind you give at a payday place, is not considered theft by deception or a "bounced check" also, the state of ky statue of limitations is 1 year for a bad check, this loan was taken out in may of 2013.

So I called them back, I explained what information I had attained, and the man proceeded to tell me he didn't care about my "bullshit" and he was going to turn my account over to the lawyer and have them send it to the commonwealth of KY for prosecution.

I get this is probably a scam, but all at the same time, it does scare me a little bit. They have not called me other than that one time, which is what scares me a little, since most debt collectors tend to call multiple times a day/week.

You may be correct that it is a scam. It certainly sounds like it. I suggest you ask them to send proof of "chain of title" of the debt or proof of "assignment" to prove they own the debt.

If they send you proof then you may want to settle with them for the original loan amount if they take off the additional charges. I doubt it will be worth your money or time to hire an attorney who will charge more than your debt is worth. Look into the Fair Debt Collection Practices Act and you will get some good ideas as to how to respond to debt collectors.

Of course, if you wrote the check then I suggest you settle with them for that amount.

It is unlikely you would face criminal charges. The police would likely view this as a civil matter, not a criminal matter. This would especially be true if both of your names are on the deed to the house or on the lease since you then have an equal right to possession of the house. You also could ask the sheriff or police for a civil assist (aka civil standby) in which you pay them to go to the house with you to get your stuff - this will protect you from her filing any sort of domestic violence charge or other charge related to going into the house. Since she changed the locks, you'd likely need to go when you know she's there. If you know that you or she will be filing for divorce, you could go ahead and start the process and then ask the court for an order to go into the house. I am a listing agent representing the seller of a home. The home was in pre-foreclosure status and sold short of what was owed on July 29,2011. The buyer of the property gave my client until 8-1 to remove his personal items as the home was rented on the day of closing. When my client arrived to remove his personal items, a bystander who was "representing" the new owner called the cops and said we were trespassing. The new owner allowed them to take much of their belongings out, but a dolphin sculpture (1 foot tall) and a custom Hawaii photo was disputed and demanded that we leave there.

To make things easy, we left it, but these were very personal to them in nature. They failed to get me a list to create an addendum to include these as personal items, so that is why this is happening now. The contract states "fully furnished minus personal items, artwork, and all owner closet contents" The vague terminology would in my opinion cause the buyer to prove these are not personal in nature, correct?

I simply want to get these 2 items for my client as he was devastated that he lost his house in the first place, now these sentimental pieces are in jeopardy of being lost as well. any advise on how to retrieve them?

Unfortunately, divorce decrees and judgments have no impact on who is responsible for the Note and Mortgage. If you and your ex were on the loan jointly you still bear the responsibility of the payments and satisfaction, even if you give up your property rights.

The worst part of this is that if you are not insolvent and don't have exemptions from judgment collection, then you COULD be saddled with garnishment and levy from an eventual deficiency judgment if there is one. You should consult with an asset protection attorney or bankruptcy attorney to discuss your options, and obligations. You may be in a position that filing bankruptcy is not a viable option.

What you should do is stop "asking". Write a letter to the neighbor and ask her in the letter to consider trimming the trees to avoid any possible damage to either of your homes. If you can do this without trespassing on her property, get a look at the trees and see if they are diseased in any way. If they are, then take pictures and include a statement in your letter that the trees are diseased and that you are putting her on notice to remove the tree or else you will hold her responsible for any damage.

Then you wait. If the trees are encroaching on your property, you can exercise self help and trim only the part that is encroaching on your property. In such case, you might want to include in your letter a statement that if your neighbor does not trim the trees then you will trim that portion which is encroaching on your side.

If you do this, make sure that you do not have your guy in any way trespass on your neighbor's property when you trim. If no branches encroach then there is nothing you can do. If the roots are on her side and the tree damages your property, then it is the responsiblity of your insurer to pay for any damage unless the tree was diseased and fell over because it was rotten and your neighbor had notice of it. That is why you should send the letter to give her notice.

Cost plus improvements minus depreciation would be their tax basis. Net sales price less tax basis is their gain. The capital gain is taxed depending on their tax bracket.

Gifting the house to you would just transfer their tax basis to you. So, that would not help. Although the gift to you would allow the property taxes to stay the same.

Moving back for 2 years would be best if they want to sell soon.

Otherwise, they should continue to hold the property until they die, at which time, there would be a step up in tax basis would would allow the inheritance at that tax basis which after inheritance would allow for a minimum gain or loss depending on the net sales price.

It is even possible for a full step up on basis if the property is community property and title is held properly (or it is in a living trust). You will need proper legal and tax advice to get all this done correctly and documented properly to minimize the tax consequences.

I suggest you, or your parents, retain an estate planning attorney and get things planned out now for the best outcome.

Your two options are for them to move back for two years, or place it in a trust so that it passes to you without probate and with a stepped up tax basis to the market value on the date it passes to you. So basically, if they need to sell it before they die, they will have to move back for two years or pay the taxes. If they can hold it until it passes to you via trust (or will, but that is unlikely to be as advantageous as a trust) then that is the better way to go.

If you have a vested right to your sick and vacation time, why not just get them to pay it to you to make up the 1/3 of the salary you are losing? Will they do that, then just use those funds to pay for the insurance, or at least part of it. You would be limited to using the additional 1/3 of wages lost and not just be able to tap into the fund to make direct payments for your insurance. From the phrasing of your question it is hard to determine what you asked for and what was denied. Will they pay you the comp and sick time in a lump sum as additional wages? That is another choice and then use those funds to pay the insurance.

You need to review the docket to see what happened between the time you took your motion off calendar and your refiling of your demurrer. I suspect that a default judgment was taken between those two events.

If my suspicion turns out to be correct, you most likely will be unable to resolve this with a phone call or visit to the clerk. It may take a motion to set aside the default, as well as a stay of execution of the judgment. The existence of a default judgment also means that your demurrer is not on calendar.

Nevada law requires the filing of a Will, in the following circumstances and in the following manner:

1.  Any person having possession of a will shall, within 30 days after knowledge of the death of the person who executed the will, deliver it to the clerk of the district court which has jurisdiction of the case or to the personal representative named in the will.

2.  Any person named as personal representative in a will shall, within 30 days after the death of the testator, or within 30 days after knowledge of being named, present the will, if in possession of it, to the clerk of the court.

3.  Every person who neglects to perform any of the duties required in subsections 1 and 2 without reasonable cause is liable to every person interested in the will for the damages the interested person may sustain by reason of the neglect.

I'm being forcefully thrown out of the startup I cofounded. My other two cofounders are trying to steal half of my shares through a repurchase notice. They did everything in their powers to unilateraly terminate my involvement. The company charter gives them the repurchase option if I'm not involved with the company and now, they're trying to serve me the repurchase notice through UPS. It just happened that UPS couldn't deliver it. I found out they are very worried about this.

My question is: what happens if I don't get the repurchase notice?

This is a serious matter that needs to be addressed as soon as possible. Generally speaking, though following the notice rules and giving proper notice is extremely important courts do not necessarily invalidate other methods of notice. Unfortunately without reviewing the founder agreements, bylaws and the actual circumstances it is impossible to determine your rights and the notice requirements. If the value of your equity or contribution to the startup is important to you, then consider retaining an attorney to help you in the matter.

Generally the review process should only take a few hours and is not costly. At the end of which you will know what your rights are and the course of action you should consider. Although it's impossible to predict the result of any court hearing, I doubt they will arrest you based on a single failure to appear. You indicated your case is a misdemeanor. Misdemeanors are serious criminal matters the outcome of which could include significant fines, probation, jail time, and a permanent criminal record that could impair your ability to find employment. You should retain an attorney to defend the misdemeanor charges if possible. In most cases retaining an attorney will achieve the best possible result, and you will not have to go to most court hearings thus saving you from having to take time off from work.

After reading your article you seemed to be very knowledgeable so I'd figured I'd pose my question to you. I was recently involved in a motor vehicle accident in NJ. On a two lane road I started to pass two cars that were driving 10-15 mph under the speed limit (40mph), it was perfectly within my rights being the the center line was broken. i have since looked up the laws on passing and confirmed this. However the second vehicle that I was attempting to pass turned left in front of me. He did not use his turn signal until just before he started his turn instead of the required 100 ft. I am being charged with wreck less driving. I can not find a law to clarify with certainty who would be at fault. My questions would be as follows:

In a designated passing area/lane how many vehicles are you allowed to pass?

When making a left turn on a two lane road is it the drivers responsibility to ensure it is safe to turn?

Who has greater responsibility? The driver passing or the driver turning?

Any thoughts on the matter would be greatly appreciated.

I think you left some points out of your narrative. How did accident occur. If one of the cars made a left turn away from you and the other car, did you collide with the other car while you were attempting to pass? You did not say this but am I to presume that a police officer wrote you the Reckless Driving ticket which carries 5 motor vehicle points. Was the officer present when this was going on or did he show up after the accident and make his or her own assessment of what occurred. Attempting to pass two vehicles at once is not the safest maneuver. Usually you can pass a vehicle making a left hand turn but you need to exercise caution when you attempt to pass any vehicle. A vehicle can make a left turn on a 2 lane roadway as long as there is no sign prohibiting such a turn. A left turn is more difficult generally to make and the driver attempting such a turn needs to exercise due caution towards on coming traffic. The Driver passing the vehicle attempting that turn needs to exercise equal caution. However to better answer your question I would need more specific information on how the accident occurred. You do not talk about that. If you choose to fight the ticket it would make sense to speak to the prosecutor to see if he would offer a downgrade to something that carries less points. Hello, I am seeking help understanding the Colorado security deposit act, specifically #7 which states: "Any provision, whether oral or written, in or pertaining to a rental agreement whereby any provision of this section for the benefit of a tenant or members of his household is waived shall be deemed to be against public policy and shall be void."

What exactly does that mean? I understand it to say that I cannot waive my right to my security deposit refund...not verbally or by signing a lease that has it written in it. Is this correct or incorrect? I signed a lease and gave deposit money in early Feb to rent a place begining March 1st. After siging the lease the owner said it was required to carry insurance. When I got the quotes, I realized I could no longer afford the place and informed the owner of this. She said ok but I will not give you your money back. In the end she has the place rented to someone else as of the 1st of March (I drove by and took a picture of the obviously occupied home) She says that when I signed the lease I agreed to comply with the full lease and all of its terms or forefit the deposit. Isnt this in conflict with CRS 38-12-103? Thank you so much for any help, in advance!

That is not exactly what it means. That provision means that a landlord cannot have a contract term attempts to eliminate the specific requirements under the statute. For example, if the lease provided that the landlord had 120 days to account for the security deposit this would be invalid because the statute provides that the landlord can have no more than 60 days to account for the deposit.

As to your circumstance, the answer depends on the lease terms and other facts. The lease could certainly have a clause that provides if you terminate early that it could hold an amount of the deposit as liquidated damages. Since we cannot see your lease there is no way to know if your lease has this or related terms.

As a general matter, the landlord must mitigate damages from a lease breach. You signed the lease and are bound to the terms and are liable for damages for that breach. If, however, the landlord suffered no damages (and absent a valid contract term) then they cannot hold you responsible for damages (such as holding the deposit amount).

There are many steps you need to take to protect your rights and get in a position to sue in small claims. Depending on the facts, you can sue for three times the amount of the deposit.

There are many things to review and do and you should speak with an attorney.

My parole officer has said there is no problem with him moving back home to live with me, but all I have researched say otherwise, should I be wary? Also I have been told I will be given permission to pick him up when he is released, won't this violate either one or both of us.

If his probation officer is fine with that, then you both should be fine. However, you may want to file a motion with the clerk to clarify this condition of probation.
