What to do if someone hit my car and admitted what they did to the police but they are now changing their story and their insurance is refusing to pay?
The police didn't take a report because there were no injuries but did get a recorded statement from the responsible driver admitting what he did, which the police agreed showed him being at fault. the way he hit me (my driver's door) from him in a turn lane makes it very difficult for him to not accept fault.
Now his insurance carrier is claiming he was stopped and wasn't at fault, disagreeing with the statement to the police and the facts of the accident. I'm having difficulty getting the recorded statement from the police and have lost $5,000-$7,000 in diminished value in my car after the repairs. How can I hold the guilty party responsible for fault and for covering the value my car lost from the damages?

My loved one was arrested for drug possession (NY first time) and offered outpatient drug rehab to attend 5 times per week until the counseling center deemed necessary.
Of course after 6 months they had a relapse and stopped attending and now they are calling me scared to go to their scheduled court hearing for fear that they will lock them up.
I am not sure but does anyone know what happens in this type of case. The amount on their person was not a large enough amount to be charged with besides possession of illegal narcotics. I am not looking to rescue them but it would be good to stay informed.Thank you in advance

Sounds like it went through Drug Court instead of reg court. There, they may (or may not) kick him out of the program and he would be faced with the sentence he/she would have been informed of when signing on to the program BUT he needs to cooperate. Not showing up is egregious and will almost certainly gtee he will be jailed at some point the minute they get him. They are understanding, at least out here and I assume elsewhere because statistics everywhere show Drug Court (and Veterans and Mental Health Special Courts work. They they really work hard because they know the only permanent solution is treatment, FORCED treatment, not bouncing in and out of jail. They even had a special seminar in Suffolk Supreme Court explaining to lawyers, social workers, prosecutors, veterans, etc. about getting people into the special courts rather than criminal court. Tell him to contact whoever is his contact and be prepared to go in, dressed nicely, ready to explain what happened and willingness to make amends. Then, he will have a chance. Not show up-no chance.

In addition to the trust, there is a valuable home, and various properties, and about 100 trust deeds. I have never seen a copy of the trust or possible will, and know nothing other than what my brother tells me. Is there some law that states an heir must be contacted by the law firm within a certain amount of time after death to clarify details?. How do I go about getting a copy of the trust. I do not know which law office holds it, and i live in a different state. Also my brother wants to wait until the housing market improves to sell the house--maybe years. May I ask him to buy my share at present market value? If he refuses, what options do I have? My brother is not in good health, and is in no hurry to settle things. It may be that you will have to open an estate for your Dad, to get the power to make people tell you the information you seek. Until then, you will be grapsing at straws to find out what is goping on. You other option is to come (or have yrou agent come) and take control; of the house. This shoudl get your brother's attention. If there are rebnters in the house (as there shoudl be) you or the estate are entitiel to the rent (or your fair share of it.)
There is no law that forces a law firm to find and inform trust beneficaries that the Grantor has died. But, the Trustee (possibly your brother) is responsible for taking care of yoru interest in the trust assets. You may have to sue your brother as trustee, if you feel he is not telling you all he should, or otherwise not taking care of yrou interest in the assets.

The law favors equal parenting, so even if Dad is not so great at parenting, he still has rights. It is very difficult to shift more time to you, especially if you work and he does not. And he is a boy. How old is your boy? A custody battle will cost thousands in attorneys fees, several court dates, an expert in child psychology, and take about a year. You will have to allow Family Court Services to enter your lives, not good. They will evaluate the home situation at both your home and his home to see if there are serious enuf issues to warrant a change in custody time.

No. Not unless you can establish that the clients owe money to the lawyer. Usually though it is the lawyer who holds funds of the client in trust. They are not earned until the lawyer does work for the client. If the work has already been provided and the clients owe the money, then I suppose you can.
I strongly suggest that if you have recovered a judgment that you seek the advice of a collections attorney who can assist you in collecting on the judgment before you start trying to seize assets, garnish wages or levy bank accounts.

I haven't gotten the land appraised yet, so I don't yet know whether it's going to go over the 2 million cap.
I hear that the state of Illinois hits you pretty hard if you do go over the limit. Is this true and if so, is there any way to minimize the hit or help stay under the cap?
I really want to pass the farm ground on to my children someday and would be very sad to have to sell somet to pay the taxes.

You are correct, Illinois does impose an inheritance tax on assets over $2 million. Did your parents have Wills or Trusts? If they had trusts, your father's exemption should have been utilized at his death.
I would need to review any estate planning documents that your parents left as well as a list of assets in order to give you an idea of whether there will be an estate tax liability and how to minimize the effect on the assets.

Use some of those liquid assets and contact an Estate or Probate lawyer in your area. Farm land is a specialized area as is estate taxation. Its doubtful that you would have to pay taxes on the full 2M valuation since your father may have had a stepped-up basis at the time of your mother's death. If your assets are as indicated you can afford to pay a specialist in this area and you should do. Free advice given blindly is worth exactly what you pay for it.

I called a few people who I thought could have done it and said their was a reward and sure enough the people who I though did it responed ( my ex's father and his girlfriend) and the nexted day they had two of the many things missing. If you are called in, it is likely because they are conducting an investigation. Because the offense was not committed in their presence, they must obtain a warrant to arrest you - they can't just arrest you days / months later. There may still be time for your boyfriend to file an appeal, depending upon when he was sentenced. It's possible that his lawyer started the process for him already. He can also petition for a writ of habeas corpus. Often the best approach is to do both.
Nothing you have said suggests that he is likely to get his conviction or his sentence reversed, but with more facts I might see promising grounds he can raise.
Although you insist that there was no evidence tying him to the shooting, you acknowledge that the victims identified him as the shooter. That's powerful evidence, even though they later told a different story. Jurors who learn that the same witness told two contradictory stories do not have to accept the version that's more favorable to the defendant.
That the victims weren't injured is also unlikely to matter. Presumably your boyfriend was convicted of attempted murder and/or some other crime that does not require actual injury to the victim. Shooting at someone with the intent to injure or kill him is a serious crime even if you miss your target.
You seem to think that the plea bargain he turned down is reason to reduce his sentence, but it almost certainly isn't. He chose not to take the deal, and he's not entitled to demand the benefits of a bargain he refused to make.

I do reupholstery for a living that is how I know.

A restraining order is the way to go. That seems to be what the court will rule on later this month. In the meantime, if there is a temporary restraining order in place and your ex's new wife violates it, call the police again. The TRO will make them much more likely to take action.

I agree with Mr. Whipple. I can't think of any legitimate reason a landlord would need or want your birth certificate. A notary is a witness that something was signed, so that seems strange, as the doctor at the time you were born signed your birth certificate, and good luck finding him now. You could get a "certified" copy of the birth certificate, which is stamped certified by the Recorder's Office.

So, if person gets 10 years and is released after 5, he has 5 years he still owes the state in custody but the state has decided to let him be out for the remaining 5 as long as he does as he is supposed to do. If the person gets finished with the 5 and then does another crime, the original case is over; he cannot be incarcerated for that old case because the time expired. BUT, if the new crime was committed say after the person was on the street for 4 years 6 months and he gets a blue warrant (parole violation warrant) before the 5 years expires, then he can be sent back to prison for the full 5. He does not get street credit.

You should have received a 3 day notice to quit, first. It is not clear from your post whether the sheriff was delivering the actual unlawful detainer lawsuit, or an actual writ of possession for a case you did not defend.

the short answer is 65 ft-lbs of torque. now for the medium answer (you don't want my long answer): always check torque specs for the specific application (year, make, and model); always torque heads in three equal increments (so torque all bolts in sequence to 22, then 44, then 65); ALWAYS torque in the proper sequence, which is basically start at the center and work your way out in a circular pattern; and always use brand new head bolts (though I've never done this--head bolts are somewhat expensive, and i don't rebuild racing engines--never had a problem [knock on wood], but the theory is that once the bolts are torqued, they stretch, or the threads stretch, or something like that, and bolts could break, or the head could warp, or the head gasket could leak--maybe I've been lucky...and i do push engines)--so if you want to do it right, use new head bolts--i just checked: about $50 for the 34 bolts, so i guess "an ounce of prevention" costs $50. good luck, and you can get some more info from http://www.boxwrench.net/specs/chevy_sb.htm

There is no way to guess the amount of compensatory damages with the limited information you have given us. Of course, this presumes that he can prove he really was injured by the dog and that your parents are legally responsible.

But if he his a young neurosurgeon who has lost out on decades of a high-paying career, the compensatory damages could be many millions of dollars. You could file for contempt if your parenting plan states that he needs to exchange at school or even, perhaps, if it has been your practice. If that is not in the plan, you might instead need to file a motion to compel or motion to modify or clarify the plan so you have a court order to do the exchange. Depending on the docs you have, you might start with contempt. If you do contempt and hire an attorney, you can ask for him to pay your attorney fees and cost (and your costs no matter what). If it is claimed to be severed, why does the mere transfer to a trust sever the joint tenancy when no other instrument including leases, life estates, wills, mortgages, sales or any other type not sever the joint tenancy?

The joint tenancy is severed because the joint tenants no longer own the property. It is now owned by the trust. If it is a typical intervivos trust, the transfer is of almost no consequence to the rights of posession, occupancy, etc., but it is a change in the owner of fee title and that severs the joint tenancy. And you are mistaken that a sale would not sever the joint tenancy. A sale and a transfer to the trust are the same, a change in the owner of the fee simple estate. The other things you list do not change ownership of the fee simple estate (although a life estate might depending on how it was structured and granted).

I made a reservation with a limo company. I signed the contract below. My party and I had our event yesterday. Once we were dropped off he did a quick sweep and said that everything looked good so I tipped the driver and went inside my home. About 5 minutes later I went outside to retrieve my friends and the limo driver was taking a picture of my 3 friends on top of the limo. He then escorted them off the limo and said good bye. About 1 hour later I received a phone call from the owner of the company stating that there were damages to the vehicle. 1. He said there was a scratch to the car that would cost about $200 for a new paint job. 2. There is a dent in the bumper. 3. the sun roof is miss-aligned. He was very accusing and aggressive and said that he will take the car to a mechanic and I am responsible for paying for all the damages. If not, then he will take me to court. He also yelled at me and said "why would you people do this to my vehicle?"
I told the owner that I understood and asked him politely to please calm down. I asked him how much it would be and he said that he will send me a receipt for all the damages and either way I am responsible for paying and if I don't he'll take me to court. I then proceeded to ask him, and state that I was confused. If it was an issue for the girls to take a photo on the limo then why did the driver allow it and encourage the ladies to take it by escorting them on the vehicle and taking the photo. The owner just got more aggressive and angry and called me a liar and said he doesn't believe me. He has lawyers and we can handle this the diplomatic way or he will file a lawsuit. I said ok, I'm not trying to argue with you I'm just confused. And basically he got angry and hung up on me.
He then proceeded and charged my mom's credit card 4 different times. the largest amount for 1500 and the smallest for 450. The payments did not go through due to the credit card limit.
As of now, he sent me an email stating that the receipt for damages will be sent to me on monday and if I don't resolve the matter and pay I will be taken to court and I will be responsible for the following:

Once I get a judgment it will be reported to all 3 credit bureaus and I promise you that I will collect on the judgement through the full extent of the law. I suggest that you read the rental agreement to its entirety.
My question is: Is this right? Is this extortion? The driver didn't state that there were any damages and how do I know that the "dent" wasn't something that the driver did. I really doubt that the ladies damaged the car that badly. Do I have any rights or a case here?
1. All reservations are NON refundable and client's are responsible for the full reservation amount if reservation is cancelled by the client. 2. (Company named will be blocked by me) limousine is not liable in the event of mechanical breakdown while on charter and will only be responsible for making up lost time at a mutually agreed date, or providing customer with an equal replacement. 3. The client assumes full financial liability for any and all damages to the vehicle caused during the duration of the rental by them or any members of their party, including spillage of any beverages, and breakage of any glassware. Confetti's, Glitters, or Silly Strings of any kind are not allowed in any of our vehicles. No eating or smoking inside any of our vehicles. No pets of any kind are allowed inside any of our vehicles. Any violations will result in a $400 clean up fee and immediate termination of the reservation with out a refund. 4. A minimum fee of $500.00 for each carpet or seat burn, $400 for any spillage, $25.00 for each broken or missing glassware, $100.00 for each decanter. A clean up fee of $500.00 will apply if any occupants/passengers gets sick and vomits in any vehicles. The client will also be responsible for the down time of the vehicle for up to 24 hours. 5. Alcohol Consumption may be prohibited by law in certain vehicles. No illegal drugs allowed. We will report any illegal drug use to the local Police Department. Any fines will be paid for by the customer. 6. The driver has the right to terminate the reservation without refund if there is blatant indiscretion on the part of the client(s)or if the clients violates any of our rules as stated in this Rental Agreement. It is Illegal to stand through the sunroof. If cited by Law Enforcement the customer will be responsible for the full amount of the citation. 7. Airport and Cruise transfers overtime/waiting time charge will apply after the first 15 minutes of prearranged time as described on reservation confirmation. We will allow an additional 15 minutes grace period for Airport and Cruise pick-ups only. 8. Not responsible for any types of delays, unsafe road conditions, traffic, accidents, etc. 9. Not responsible for articles left in the vehicle. 10. Vehicles cannot be loaded beyond seating capacity. The driver will deny entry if there are too many passengers. 11. A 50% fee will apply for all cancellations authorized by 4Ever limousines. 12. I agree to have my credit card charged for any damages to vehicle caused by me or any of my guest during my rental period. This includes overtime/waiting time above and beyond my agreed rental period and or pick up time. If I dispute any charges with my Bank and lose I agree to pay $150 dispute fee to 4 Ever Limousine. 13. All overtime charges for all hourly rentals are charged at the regular rate and not the discounted rate. 14. I agree to pay for any tolls or parking or any other fees incurred by my reservation. 15. A charter may be abandon by (company will be blocked by me) Limousines if any customer does not show up on time and/or with-in one hour of a scheduled charter, and this customer will be responsible for the full chartered fare. 16. A $75.00 fee will apply for any changes made to a reservation with less than 24 hours notice. 17. A $50.00 fee will be charged for each non-scheduled stop. This only applies to transfers, point-to-point service, and not hourly rentals of four or more hours. 18. A fuel surcharge will apply for any stops that is thirty miles or more from the first pick up location at a rate of $1.50 per mile. 19. A $55.00 fee will be charged for all returned checks each time is presented to the Bank. All returned checks are deposited twice. 20. Any delays for airport and cruise line transfers will be charged to the customer at a rate of $40.00 for every thirty minutes for sedans, $60.00 every thirty minutes for limousines, $80.00 every thirty minutes for SUV'S, $100.00 every thirty minutes for stretch SUV'S, and $100 every thirty minutes for party buses. 21. All Airport and Cruise waiting time charges are in 30 minutes increments there will be no pro-ration. All over time charges are billed by the hour. No pro-ration. 22. The start time is the prearranged pick up time as indicated on your reservation confirmation. The end time in the final drop off location. 23. A $75.00 fee will apply for any same day reservation changes and if any flight is delay for more than one hour from the original prearranged pick up time, and (Blocked) Limousine chooses to re-dispatch an available vehicle. This decision is solely (Blocked) Limousine. The decision is based on available drivers and vehicles. 24. A 100% cancellation fee will apply on all cancelled reservations. 25. A 5% fee may be added for credit card transactions. 26. This Rental Agreement is your Reservation Confirmation for transportation services for the above listed date and time. There will be no further confirmation required by either party. 27. By accepting and/or using our services I agree to all of these terms and conditions.

I would argue that the damages to the outside is the drivers, two once he did the walk around and took the money the contract ended and the driver acting as agent told you everything was ok. Subsequent damage belongs to driver, third you don't do a new paint job for a scratch. The next day, they gave her a call and told her about the price to be $3,500 including wheel alignment but the thing is that when she hits the car, it was only side to side and she didn't even touch the wheels of the other driver comparing to the damage her car received. Also with the pictures she has, the damage wasn't even bad. By now you are realizing the problems caused by not handling such situation correctly. Having police come and make a report avoids disputes over who was at fault and what the damages are.. Your opinion about fault or damages is irrelevant, or at least is not the deciding factor, without such reports in your favor. I am being sued in small claims court by (allegedly) a debt collection agency regarding a credit card.I am certain that the last activity on the credit card was almost three years ago -- possibly within the SOL, but I'm not certain. Furthermore, I've never heard of this collection agency before and I'm not sure they have the right to collect any money on this account. Since I'm handling this pro se (I've been unemployed for several months and cannot afford a lawyer, much less pay a debt I probably don't even owe), what documents should I have their attorney send me before the trial? And what is the best way to defend this in court?

Collection agencies very frequently fail to bring the documents they need to prove their own cases. They also often violate the Fair Debt Collection Practices Act while pursuing litigation against people they allege owe them money. In order to prove their case, they have to not only show that you actually owed the amount they claim, but also that they have proper authority to sue on behalf of the original creditor.
It is really unfortunate that you can't hire a lawyer because the best way to tackle these is to not show up in court, and to send an attorney instead. See, if you show up yourself, then the collection agency attorney can call you to the stand and question you under oath about the debt. That way, even if they don't have the documents they need to prove their case against you, they have you there to testify, and unless you want to commit perjury, they'll have your admission right there.
As for what documents you should demand before trial, that is a strategic decision you'll have to make yourself (or with the advice of an attorney). Because collection agencies often don't show up to trial with enough proof, it sometimes is better to not even contact their attorney because most people in your situation never show up for court, and if he never hears from you, he'll assume that to be the case. However, calling him and asking for documents may tip him off that you're serious about defending the case and motivate him to make sure that, at least for your case, he has whatever proof he can get.
Before you despair of hiring a lawyer, these cases are very routine and don't involve much work. If you can find a lawyer who will be at the courthouse that day anyway or doesn't have much to do on your court date, you may be able to get him to surprise the collection agency for less than you may expect to pay. I handle these cases for $100 plus (if I win) a small percent of whatever is saved.

I am a business consultant about to sue a former client who is refusing to pay a $3,200 bill in full. The client did not follow my directions and feels that he has an incomplete product - regardless, two months into the job, he ended our working relationship without allowing me to finish it, stating that there were higher priority items coming up and it was "no longer important." He is refusing to pay more than 50% of the final bill. Since the amount I'm suing for is for over $3,000, I cannot go to small claims court according to Ocean County Small Claims Court, but to "Special Civil," which I've never heard of. What is the difference, and is a lawyer going to be mandatory in this Special Civil part?

If you were closer, I would suggest that you consider attending my course "Sue Yourself!" which is starting next Tuesday evening at Camden County College in Blackwood. (2 evenings) Lacking that, consider reducing the claim to $3000. The case will go to mediation first and you can always negotiate around the $3200 figure. You don't have to have a lawyer in Special Civil Part, but it would significantly increase your chances of a win and decrease the possibility that you would waste your time.
If you do this kind of work often, you may consider having a business lawyer review your processes and documents. In a well-organized business, attorney fees for collections are permitted by contract. That goes a long way to settling disputes and making your work more attractive to lawyers when and if you have problems.
