My mom suffered from dementia but knew what she was doing when she updated her will and did so at a reputable attorney's office. Does my sister have a legal right to contest?

A person with dementia may or may not have capacity to write a will. Your sister should immediately hire an experienced lawyer to protect her interests. Hopefully her grandson has already also retained good counsel.

Anyone can contest a will if they have legal grounds. Telling us that your mother has dementia does not tell us much. If her dementia was bad, then her updates might be invalid if she lacked the mental capacity. However, if her doctor felt that she was competent and the lawyer who did the updates believed that she was okay, then maybe the will would hold up in court.

Even if the will is tossed out, its not going to revive the old will. What would happen is that any property would pass via the intestacy laws as your Mother would have been treated as if she had no valid will. But without knowing mroe about her situation and looking at the documents, its hard to say.

I hope the executor under the updated will has an attorney. If the sister is a drug addict, its not likely that she is going to be able to afford an attorney for a caveat challenge to the will. Litigation is hideously expensive and most lawyers will not take this type of case on a contingency fee. Unless your sister has a really good argument and is going to walk away with a good sized chunk of money, a lawyer will not want to get involved unless your sister can pay. Howeever, from what you have stated, unless there are other significant assets, it sounds like your sister would be better off with the life estate.

The order to properly bleed the brakes is as follows:
1. Top up master cylinder.
2. Always start at the wheel closest to the master cylinder and work to the furthest from the master cylinder.
3. Open the bleeder nipple on the wheel nearest to the master cylinder.
4. Have an assistant depress the brake peddle and hold it to the floor.
5. Close the nipple.
6. Top up master cylinder and then have assistant release the brake peddle.
7. Open the same nipple again. Have assistant depress the brake peddle and hold.
(Continue this procedure until all air has been pumped out of this section of the brake line and only brake fluid is pumped out.
8. Close the nipple and move to the front wheel on the opposite side.
9. Do the same procedure on this wheel i.e. open nipple, depress brake pedal and hold, close nipple, top up master cylinder, open nipple, depress brake peddle etc.
10. Follow this procedure for the rear wheel nearest to the master cylinder, and finally with the wheel furthest from the master cylinder.

I second Attorney Ashman's and Attorney Malekabadi's sentiments. This is really a sexual harassment issue - the $000 allegedly owed is secondary. Get to an employment attorney specializing in sexual harassment NOW.

I don't understand why the doctor is claiming that you owe $5000 anyway. Even if you signed an employment contract, unless there is something in there about liquidated damages, I just don't get it. Most employment contracts involve issues over non-compete clauses.

However, this is also an employment issue. I don't handle employment law at all and that is why you need to see an attorney who does.

I'm not sure how your step-mother's intent is any more ill than yours. What you're seeking to "protect" does not belong to you, and it may never belong to you. Unless your father wants to show you his Will, you have no right to see it. I hate to sound like the tough voice of reality, but your father is not required to leave you any inheritance at all.

If you have concerns about your step-mother, consider first discussing the issues with your father. Understand that your attitude toward her is likely to adversely affect your relationship with him.

You should be aware that since the original order the MD child support guidelines have been updated, which has resulted in higher amounts being required. Some counties want the money so bad that they extend probation if you have not finished paying everything. They have to extend it because they do not have jurisdiction (the ability to order you to do something) if probation terminates.

In some ways it is better for you because you will have a better chance having the conviction expunged.

In the meantime, the Defendant's wife sent out a 7 page letter to a lot of people including all of the witnesses I have in my behalf. To say that this letter is defamatory is an understatement...she FALSELY accused me of everything from stealing from the government to being a sexual deviate. I am convinced that her husband, the Defendant, played a part in this letter as well.

Needless to say, I want to take legal action against them for his grossly defamatory letter, but I don't know if I can file another civil suit while I have the first one already pending.....I don't think wanting to take action against this defamation makes me a "vexatious litigant."

are the prop 36 case and the petty theft charge in 2 different courts? 2 different counties? how long ago was the missed court date? (how long has the warrant been out there?)

A bench warrant is an arrest warrant, so an arrest may happen if you walk in on the missed petty theft case and/or on the drug case, depending on who has jurisdiction. The warrant would have been issued by the court in the petty theft matter, however, files can be put together and calendared, depending on jurisdiction.

That would mean you are facing other "open" issues, such as a pending petty theft charge, when you go to court on the prop 36 matter. If they are in 2 different counties, that is very unlikely unless an attorney asks for and succeeds in having the cases put together.

An attorney can clear the warrant for you without your being present. If you were on probation at the time you missed the court appearance then technically, yes, not appearing in court would be a probation violation, if you signed a promise to appear.

At least the (alleged) violation wouldn't be a drug-related violation (if a violation at all) - the timing of these occurrences matters. Again, either way, an attorney that regularly practices in those courts, is your best bet. Good luck!

PTI is a state run program and it is all at their discretion (for the most part). I have had clients get kicked out of PTI and then talked to the state to allow them back into the program. If it is some sort of clerical error, then they MIGHT let you back in. However, without proof of dropping off your paperwork, the burden is on you, not them, to show that you actually did what they required. Even if you are not allowed back in, if you have an attorney assisting you, then that will greatly help any issues you have with "the mercy of the courts."

Second, if in fact the owner was a legitimate corporation your chances of recovery are slim, as usually a defunct corporation has no assets. Nevertheless, because corporations are listed as "fictitious names", there may not be a corporation and the business may have been a sole proprietership. You can obtain information from the Pa Dept. of State Corporation Bureau who can provide you with documents that identify the individual persons and address who filed the fictitious name listings. I would then go to your local District Justice Office and file a Civil Action against the individual(s) who registered the fictitious name.

Yes although you have two issues:

1. Your ability to prove all of those facts; and

2. Whether it is worth your time/money to recover it.

I don't know how much it might cost to repair the engine but that would certainly play into the decision whether pursuing litigation makes sense, in particular the amount you have to pay out of pocket. Once you know whether you will have to pay for the repairs out of pocket you should talk to a local consumer law attorney.

Your husband would have to pay for the cost of insuring only this child. It appears that there are a bunch of you on the policy.

So courts are trying to be fair. Some judges would take the total and divide by the number of people insured. I suspect that your husband's cost would be around $100 or less per month for a minor child on an insurance policy. You can calculate the insurance both ways that you listed above - try to determine what the children cost and divide by the number of children.

It sounds like you're doing the best you can under the circumstances, and I don't think the court in MD will feel otherwise when it comes to ordering child support. Your ex is required to support his son under the child support guidelines. Once you have legitimate day care expenses, he is required to contribute to them as well, but you will probably have to work that out or have another hearing later. Given your pregnancy, I don't think the court will penalize you for not working until you give birth, at least not full time.

You do not need to worry that the court, either in Florida or Maryland, will deny you child support because you are not working. In both states child support is calculated based on the incomes of both parents, but if one parent is unable to work because of a legitimate reason the lack of employment won't be held against him or her. In Maryland, caring for a child under two years old is considered a valid reason for not being employed. You should file for child support immediately. Community property ends when the parties separate. Unless the court finds that the pension was community property then you don't recover.

If you can show that the community owns a share of the pension from when it was acquired then you could ask for it based upon the community's interest.

The court's are reluctant to grant prejudgment interest in family law so not very good because the person was not noticed of the claim.

The fee is statutory and perfectly fine with the court. If the executor failed to makes payments on the car which was part of the estate, that issue that can be contested by the beneficiaries to seek restitution.

May of 2011 I was informed by my sons teacher at school that she was late to get him on more then one occassion and he was being dropped off at a friends house he attends school with whose parents who do not speak english. the mother expressed concern to the teacher for she had no contact information and because i was not informed of where my child was. At this point i went to confront my sons grandmother and she tells me " she can do whatever she wants with her grandson!" I told her she would no longer watch my son and she told me to leave her home ( kicked us out of her house) and she was going to call DCFS to file false accusations against me. I make new living arrangements and receive a motion to go to court in the mail.May 25 I had to go to court for a motion for grandparents visitation. When making the appointment with the mediator she threatened to sue me for deformation of character when i did nothing. July 21 went to mediation she wants 1 weekend a month, 2 weeks a year, and for me to pay 54.00 every time she is caring for my son. This is outrageous there is no agreement made and she now threatens me that she is going to get full custody of my son . I receive another motion in the mail July23 to go to court in 2 weeks. I now fear for the safety of my son and worry under her care if granted visitation that I would never see my son again because of all of her threats to me. His grandmother is not responsible at all and may have underlying mental health issues due to the actions she has made while in the care of my son. there have been way too many mistakes and I just want her out of both of our lives for good because that is in the best interest of my son. Since this case I have been suffering emotional trauma and the stress has increased my migraines and decreased my trust. Anyone that can help me please this has been a very painful process and I just want this to end so i can focus on whats really important my son living a good life and being safe. There is no obligation to the buyer. An asking price is a benchmark provided as part of a solicitation of offers to buy. It is not an offer to sell at that price. As to the agent it is a little more complicated. Theoretically once a willing buyer has been obtained at or above the asking price, the listing agent has fulfilled their obligations. However, the buyer may not qualify for the loan, or may not accept the condition of the property and withdraw from the contract, etc. Therefore it is generally held that the seller can counter the offer at a price above asking, and/or keep the agent working on finding a better buyer, including one who will pay more, until the deal closes, or at least until contingencies have been removed on a sale contract. The one exception is where the seller lets a listing agreement expire or cancels a listing agreement after a buyer has been obtained who offered the asking price. At that point the court will consider whether the offer would have resulted in a closed deal had the seller accepted the offer instead of asking for more and might award the agent their commission.

It would really be helpful to know more facts, for example, a description of the deal problem that has arisen or might be arising. However, I can kinda guess and offer a few words of wisdom which may or may not answer the question. A buyer's "meeting the asking price" is only part of what's required to conclude a deal and place the buyer and seller "in contract." First, making a full-price offer is exactly that; only an offer. An acceptance is necessary from the seller before the parties are under an obligation to one another to complete the sale. The seller is not obliged to accept an offer. Further, the seller may expect more than just meeting his asking price. The seller may have other requirements such as timing of the closing, financing arrangements, etc. etc.

Effectively the statute of limitations has been satisfied, because the ticket was issued. That is what must be doen within a certain period of time. But, effectively, many judges will recall old failure to appear warrants, if the person appears and deals with the underlying charge. If this is you, you shoudl either Pro Se or with counsel get the ticket and warant added to the judge's docket in the jurisdiction in which you wre cited fo rillegla parking. Ask the judge to recall teh warratn and allow you to deal with the ticket itself. I have heard of people not doing this and then getting arrested on a twenty-year-old warrant. If such person got pulled over for speeding, and they ofice rwante dto ser4ach the vehciel, but did not have probable cause, arresting the person for the outstanding warrant would give them permission to inventory the contents of the vehicle. It seems that unless the Police suspect the person of committing a harsher crime, they would not want the headache of arresting someone on such an old warrant. But, why take the chance?

You have the right to hire your own attorney if you want to and are able to do so, but ultimately a person who is ruled incompetent may not enter a plea nor can they be taken to trial. A person must understand the system they are in and be able to assist in their own defense. If experts find a person incompetent to proceed then the case will not proceed. Generally, at least two experts must find the person incompetent to proceed. If the court has ruled that you are incompetent to proceed then your case cannot yet proceed to trial. If you believe that you are competent to proceed to trial then you are welcome to raise the issue with the court by hiring a private attorney or by convincing the experts who have already evaluated you.

The ''dumped'' because my wife and I were confidants thoughout her ordeal, this man got it in his head that I was his lovers replacement. (I am not). The staement in the note was definitive, it said, ''your husband is having an affair'' and left the locations and hotels as generalities. He cannot have any proof since the allegation is untrue and none of the events happened in the context presented.

This is actionable defamation (libel). However, you have limited damages unless someone believes this. You certainly can seek a court order forbidding future such contacts -- but that may bring more attention to the affair that -actually- occurred than it is worth.

A letter from an attorney telling him to desist is certainly a reasonable possibility.

In Massachusetts, it is a misdemeanor to harrass. You might thus bring the matter to your local district court to seek issuance of process. The clerk-magistrate who hears the matter after notice might well tell the jilted paramour to cut the crap, leaving the decision open for a few months.

With all such matters, your difficulty is in determining how much you need and want to get into this. A court action could be expensive and drawn out.
