Hello, I'm In Pro Per and struggling desperately with default judgment paperwork. I have attempted to file four times and it's been rejected four times, each time with new issues. Can you please tell me what specific forms I need to file for the default judgment paperwork?
Also, the most recent rejection states that because my spouse and I signed an agreement for nominal child support (without involving the court), that I must complete the "child support information" (page 4 of the FL-150 form, which states "fill out this page only if your case involves child support") and that I must include the only original copy of the notarized agreement with my form submission to them. Is that true?

Report him to the police and sue him. Also, your brother may have a Victims of Crime claim which might pay his medical bills. He does not have a civil lawsuit against the host of the party but he certainly can sue the puncher for assault.

If you have not already had it, there should be hearing coming up soon, on teh PFA. At tha thearing you shoudl raise the issues you described here. You may wan tto hire counsel to represnt your interests. If a hearing has not been scheduled, you may need to file a motion to quash the PFA.

Read the child support statute. I'm sure that it was largely written by non-lawyers. Generally speaking, the statute says that child support stops when the child reaches 18. BUT the FSD takes the position that they will continue to collect the child support even affter the child turns 18 on the belief that the child will enroll for a full course load in college by Oct 1 following graduation from high school, maintain suffiicient grades, make all tof the required reports to the parent paying child support in a timely fashion and therby force the obligation to pay child support to contiue until the child is twenty-one or graduates from college whichever occurs first. If the child fails to comply with all of the requirements of the statute, you should immediately file a Motion to Terminate your child support obligation. You can hire an attorney to help you, or you can try to get this done representing yourself.

Anyway I had a deposition, my police reports, surveys, notified nj insurance commission to no justice. I still have this boat, not running, dry docked at another location. I still must pay insurance to the same company, because they say I cannot obtain another till this is resolved. I will be going to arbitration, and my question for now are: 1) Can I recoup my storage, depreciation and usage 2) Why was this not settled with the property owners, where the boat was dry docked. They called their boss, who had dropped them off and pointed to MY house as the work site, and he came to fix things. His idea of fixing it was to yell at me and demand $250 for the service. Then he yelled at my neighbor and demanded payment. My neighbor refused to pay because his lawn hadn't been done. I refused to pay (but I did offer to negotiate) because I'd never even heard of this company, much less hired them. He would accept full payment and nothing else. The more we talked the more belligerent he became and the less I wanted to be in a conversation with him. So I thanked him very kindly for the free lawn service and went inside. He shouted at my back that he was going to call his lawyer and sue me. How many cards does he have? Who has the legal high ground?

I have to answer this question if only because it reminds me a case I read in law school. It was similar except that a roofing company came and put a new roof on the neighbor's home, who was out of town and did not notice.
The court there rules that under an equitable theory of "unjust enrichment" the neighbor still had to pay for the new roof, even though they did not ask for it, because the contractor had in good faith (albeit, by mistake) put the roof on the home, thereby conveying something of value to the non-requesting neighbor, which increased the value of said neighbor's home.
However, there is no legal theory (as opposed to equitable theory) to support such a requirement, and I recall reading a similar case to show where the opposite could occur, when the court did not consider the equitable theory, and simply held that there was no contract, that the contractor's work performed was done without permission and therefore is non-compensable.
For $250, the most you are going to get to is small claims court. He'd be wise to move on and check the address next time, or require someone to be home before he starts the work.
If he's bright, he'll take you up on a negotiated settlement and cut his losses. Depending on which judge you see, you may get one result or another. Bottom line: neither of you has the high ground in my opinion. If I were the judge, I'd likely split the difference and award the contractor his cost of labor and gas, but not give him the profit. Maybe $50-100 to him.

A public defender will be appointed for you on the first day you are there for arraignment. If you can afford an attorney, the judge will grant you an adjournment to get a lawyer. Don't talk to the ADA. I know the criteria for a public defender in Westchester County is that you make $400 per week or less and do not own a car or home. The criteria might be different in other counties. If the court clerk is really on the ball, he/she will call the names of the new arraignments and tell them to go to the window for an application for public defender/assigned counsel/legal aid and fill it out before court starts. You might want to get to court early. The application is basically a financial affidavit.

Same-sex relationships are treated exactly the same as separate sex relationships in custody cases. He was driving on a suspended license so he will get a fine for that on his AZ traffic ticket. He needs to pay his California tickets and get the license reinstated. But of course if he paid the tickets he wouldn't have a suspended license. AZ probably wont give him a new license until he clears up the California license. I am surprised that he doesn't have active warrants out there on the tickets. Ultimately, if the tickets go into warrant, he will be arrested on the warrants.

As things stand, there's not much you can do--she has just as much a right to have the kids with her as you do. The only way to change that is by having a court lay out when you and she will have the kids, along with various other things like who gets to pick where they live, deal with schools and doctors, pay support, and so on. You can get that accomplished either with or without filing for divorce, so if you don't want a divorce right now, you'd just file what's called a SAPCR ("Suit Affecting Parent-Child Relationship") suit in the family court of the county where you live, assuming it's been less than six months since she moved out (if it's longer than that, you'd do the same thing, but file in whatever county the kids are in). You can also ask that the court put in place temporary orders that would at least let you see the kids while the case is pending. Good luck.

As a result of debated performance of my role the company has ended my employment.
The company is refusing to pay me severance which I think I am owed. I expressed that I would forgo asking for severance as long as I was paid my sign-on bonus. They replied that it is not due for 3 months and therefore do not have to pay me as I will not be employed.
Again my argument is that it is a Sign-on bonus and nothing after joining the company matters. It is not a retention bonus and the terms do not say that I will forego it if I a terminated.
In fact the Addendum states that I will not be required to reimburse the company for any portion of my Signing Bonus if my employment is involuntarily terminated by the company for any reason other than for Cause, or if my employment is terminated as a result or your death, or disability.

The important thing is that you sit down with the medical office's manager and explain why you cannot afford more. If your financial situation demonstrates that a $50 payment is what you truly can afford to pay, they will accept that and may even offer additional discounts to help you out. The absolute worst thing you can do is just ignore the bill, and hope they won't chase you down. I dismissed the NISI case the day before. I filled it with the clerks office and hand delivered a copy a copy of the dismissal to the judge secretary.
After receiving the TPO, a week later I get a postcard in my mail stateing I had a court hearing in 30 days. The paperwork stated in part they want to take my kids. My children have lived with me full time for the last 3 years without any problems. She is making all of theses false allegations. They can't just take my children from me like that can they?

Depending on the amount of time that has elapsed since the hearing, if you were not personally served by a Sheriff or process server, you may be able to set aside the order and move forward with a hearing. You definitely need to retain an attorney. Also, if you decide to file for a divorce, the outcome of the divorce can override custody and visitation issues. The TPO stay away order would remain in place for the 12 months.

Property settlements/orders to pay are not recognized by the mortgage companies or banks yet litigants are lead to believe that the matter is taken care of through the decree. If the orders to pay are meaningless and the court knows this, then why is this not an act of fraud? If the decree is not followed one must pay more money to have a motion filed to enforce it.
Thousands of people are having their credit destroyed by former spouses and it is all with the backing of the court system. If the former spouse is ordered to pay and does not pay the bank issues a foreclosure order on both parties.
Even though the court has turned the property over to one of the two parties, both are obligated to pay in the eyes of the bank. If the court and legal system is basically selling these useless decree orders than I think someone should raise the issue of fraud!

Support is calculated on his income only, after taxes and certain deductions. By getting married his taxes and deductions probably will change. I have lived here since Mar.'02 and have until recently had a assigned parking space. The problem is that around Jan of this year the new management co had the parking lot resurfaced and re-drew the car slots (larger), so now there are 18 less spaces than before. Right around then I and other tenants received notice that I am no longer allowed to park in the parking lot as there is nothing written in rental agreement about my spot. My parking was verbally assigned by the previous management and they have written a letter to the current management stating so. They are stating that the letter doesn't matter as there is nothing in the original rental agreement. Does this count as an illegal reduction of services and how can I get them to reinstate my parking spot?

It would seem to me that it definitely is a reduction of services; I am not familiar with Hollywood's rent control laws but I would assume that is illegal and a significant reduction in services. Your problem is likely not that the management company has changed but rather the ownership has. I also assume that you have not signed a rental agreement for years but rather are on a month to month tenancy, so the prior written contract only applies to show what was done in the past but any changes in the oral agreements are permissible as long as their is mutual agreement. If the landlord offers something in addition to what was originally not covered in the written agreement, then when the next oral renewal of the rental agreement occurs that term is added to the contract. If a year after you had first rented you had to change from unit #1 to #3 and lived in the latter for 10 years, would they argue you have to move back into #1?
The parole evidence rule does not apply [you can not introduce evidence of oral changes to the written contract because to do so would mean that no written contract would be binding] because you are not dealing with one written contract that has existed for 9 years, you seek to show a change in the contract made before the last contract, and the behavior of the management company acting as the obstensible agent of the owner ratified by their actions the addition of terms to the later renewed contract.

You do not post enough relevant information here. You getting a cell phone for someone else was DUMB. If the cell contract is in your name then as between you and the cell phone company you are liable for the bill. So if the other party stops paying, you are stuck with the bill and your credit gets trashed.
Some debt collector is now going after you for the bill. Settling is great but you need to start being smart about how you go about this. Have you asked for written proof that this is indeed your debt? When was the last payment of any kind made on the debt? If you think $736 is a good deal (its not - I would not settle for more than 50% or $600 but I would start off my settlement negotiations at a lower amount) then you get this debt collector to send you a written settlement letter indicating that if you pay the settlement amount then the debt will be considered settled in full. Get a money order or certified cashier's check and make a copy before you send it to the debt collector. 30 days after your settlement call the debt collector and get a final closure letter. Keep the settlement letter, copy of your payment and final closure letter FOREVER. You want to be able to prove that you paid in case the debt gets sold and some other collector comes to ask for the balance.
If this is on your credit, in your settlement negotiations, ask the debt collector if they will delete this from your credit because this was not really your debt. Its called "pay for delete." Some debt collectors will do it on a settlement and some will want the full balance owed. Some will not. If they will not, then that is that ... try to settle it for as low as you can go.
Only agree to pay or settle the debt if the last payment was made less than 4 years ago so make sure you ask in your settlement negotiations when the last payment was made. If it was made more than 4 years ago, tell the debt collector to take a hike if they want money to settle this. There is no virtue in paying on a debt barred by the statute of limitations unless you need a mortgage or credit. And if you pay less than the full balance on a debt that is barred by the statute of limitations, you are reviving the statute of limitations - so that settlement letter becomes doubly important.
The second part of your question involves the "friend" who you got the cell phone for. What exactly was the agreement and how did that happen? Do you have anything in writing by which this person agreed to be responsible for the bill? Do you have a history of this person making some payments on the account? What happened and why did the person stop? When was the last payment made?
You ask if going to court is worthwhile. The answer is it depends. There is no wage garnishment in PA for a debt of this kind. So even if you get a judgment, how are you going to collect on it? There is a process and the small claims court can order payments if you ask for it. But if the person does not pay, then what? You are going to have to get a lawyer to try and garnish the person's bank account. You could easily end up spending $750 just to collect.
Still a judgment does have value but the judgment will not be on this person's credit report until you transfer any small claim judgment to the court of common pleas. if you do not know how to do that, you will again have to get a lawyer.
But all of this is only if you win in small claims. There are no guarantees here and small claims judges may or may not even be a lawyer and can do whatever they want. And if you have nothing in writing and no evidence to support the fact that the other person was responsible then you do not have a case. And before you have a case, you need damages, which means you will have to resolve the debt with the cell phone company first and your damages will be whatever you pay to the debt collector. So if you settle for $736 then $736 is what you sue the person for, not $1220.
Is all of this worth it? Probably not in my book - chalk this up to one of those hard lessons that you learn for not thinking things through. Don't get someone a cell phone. You can buy a phone as a gift if you want but let any person be the one whose name is on the contract. If they cannot get a cell phone without you, too bad for them. Let them get a pay as you go plan and you will not end up victimized, left with debts and trashed credit.

California law is ambiguous on this point. The problem is that employers were trying to skirt the rule by not letting employees take lunches until the end of their shift. So the labor standards enforcement people have issued various conflicting rulings on when the break must be taken. It is pretty clear that unless the employee agrees in writing otherwise, the break must be made available to them within the first six hours. Some rulings have said 5. There are also rulings that the employer must make sure the employee takes the break and others that say the employee must simply be given the opportunity and relieved of all duties for 1/2 hour, but if the employee chooses to work through the break the employer cannot be penalized. The bottom line, though, is that even if you were 100% right that there is no legal requirement that the meal break be given within the first 5 hours, your employer has every right to control the timing of breaks, so long as they are not timed to circumvent the law (such as by giving you the break after 8.25 hours and then having you clock back in at 8.75 to 9). So they don't have to be right about their reason; they are free to require you to take your break in the first 5 hours for no reason at all.

I have had concussion issues in my past playing high school football. I went to college to play football and they gave me a very outdated helmet. I requested a new helmet because I knew the dangers of having an unsafe helmet. I ended up getting two more concussions while playing my freshmen year. I developed epilepsy as a result of my last concussion and had to quit the team. It cost my parents a bunch of money in medical bills and paying for medicine. It also cost me a great education as I had to transfer schools because my grades dropped considerably due to my epilepsy. I just want to know if I can sue the university for refusing to give me a safer helmet?

My advice would be to replace it with a rebuilt pump and not attempt to rebuild the one you have. The difference is cost is not that much. Just go to your nearest Auto Parts Store and buy one. You would first have removeit from the engine, which is the hardest part. You will then haveto disassemble the pump. You can install the rebuild kit's sealand reassemble, then re install. There is a rebuild write-up on the"yotatech website" to help guide you through it.

I stopped paying my credit cards in 2008. 3 months ago I opened a Wells Fargo checking account & was notified 8/17 that a "funds hold" was placed due to CIR law (collections agency). CIR law has my current information because they regularly send me mail and called me. I have never received any other paperwork from them besides "seasonal settlement offers." Do they have a legal right to hold my bank account? I have two children. Automatic funds are sent through the account for child support.

CIR Law is a debt collector. Generally, they purchase charged off debt from credit card companies and try to collect. If they have a hold on your bank, this means they have a judgment -somewhere some how they claim to have served you with a lawsuit and that you never responded. I see you are in Duarte. I would encourage you to check the information from your bank - there should be a case number on the paperwork. Reveiw the court case and see when the judgment was entered. Then you can plot a course of action. It may be a motion to set aside the judgment or it may be soemthing else. But whatever you do act quickly as you have a window of time that is starting to close.

In past 2 years, the surviving children have found some intellectual property rights (copyrights) for books he published during his lifetime. While the asset value is somewhat questionable unless the books are reprinted, at least two publishers have made tentative offers for both known published works. There is also one complete work which is unpublished.
Probate filing in California is $2500, publishers are offering nowhere near this amount. So what happens to the copyright if the asset is not probated, and do any new monies have to stand for the old debt which is now probably outside the statute of limitations for collection?

Therefore, I suggest you re-ask your question under that heading, or something resembling probate law such as 'wills, trusts and estates' or 'administration of estates' where it will be referrred to more lawyers and lawyers with more knowledge of the subject.

Yes. Basically you're entitled to have of the pension he earned during the time you were married. See an attorney, to divide the pension you will have to do a Qualified Domestic Relations Order (QDRO) with the divorce and this is better done by an attorney. Don't let anybody talk you out of it, unless you can get equivalent value from some other marital asset - but valuing these things is a tricky business that should be done by a qualified expert.
