Unfortunately, pro bono or not, there may not be an immigration benefit available to you right now.

I suggest you start with Legal Aid or a similar agency. If you are in Los Angeles, I know there are several of them here, including the L.A. County Bar Assoc Immigration Legal Assistance Program, which is in the Federal Bldg in downtown L.A.

There is no judgement on my credit report and the original judgement was in 2005 and I have not received any letters from them stating that they were going to take out any money from my check. My employer got a letter and just started taking money out of my check for the garnishment.

As you were told in the other post, your credit report has nothing to do with the issue. You have a judgment against you. The creditor is not taking steps to collect. That is how it works. They don't have to send you a letter, and your employer likely received a Court Order, not a letter.

And your question is? This is legal. Credit reports and judgments are two different things. If the credit bureau does not report this, its a boon to you so I would not make an issue of it. Judgments can stay on your credit report for 7 years after the date of entry. Credit bureaus may take a judgment off within 6 years and 9 months if you disputed it so maybe that is the explanation.

Just because a judgment is no longer reported on your credit does not mean that it goes away. Judgments last forever. They can be revived which means that if revived, they can be enforced by garnishing your wages or liening any property or bank accounts.

Rather than allow the garnishment, I would get a consult with an attoney. If you have a lot of debts, then maybe you want a bankruptcy attorney. If bankruptcy is not an option, then you might want to get an attorney who does defense of garnishments who can review the garnishment and see if there are any legal grounds to challenge it and see if the judgment was properly revived. You have to be served with the notice of garnishment, so perhaps you did not receive it yet.

If the garnishment is proper, then you might want to see if the debt can be resolved. The judgment will not go away and it would be better to settle than pay out the full amount. In such case, I would find out what the balance is on the judgment today, realizing that interest has accrued on the judgment, so it will be bigger. Once you know the number, see if the law firm or creditor will accept 50% to settle this debt. If so and if you have the funds, get a written settlement letter and get them to agree to mark the judgment as satisifed onced you pay, If they want more, see if you can use what you have as a down payment and pay the balanced over 1-6 months. If they still want more and will not let you pay out, keep saving until you have the funds.

It depends on the size and complexity of the estate. Average time is 12 to 24 months, but could be less or more depending on the type of assets, where they are located and the number of any claims.

Since mom owns property in multiple states, you may have to have a primary estate where she lives and ancillary estates where she owns property.

Mom sounds like she is still alive and mentally competent. If so, your mother can make this easier for you by considering paying a lawyer to draft a revocable living trust. That way, you can avoid the whole probate mess. Probate in NC, for example, is not too bad, but in other states, it can be a nightmare.

Failing that, by making sure she has a will that provides for you to sell the property if needed without a court order.

You know it isn't a positive thing. It may alter their ability to get some jobs. It might alter their ability to get some loans, licenses or permits. If that person is charged with antoehr crime int eh future, the prosecutor may take a disorderly conduct conviction in account when deciding whether to make plea agreement or to try the case to conviction. If the DO charge does not result in a comviction, the defendant may be able to have the record sealed, to prevent some of the possibly problems mentioned above.

After receiving a default judgment in small claims court because the defendant (properly served) did not appear, and after waiting 30 days, I filed an Order to Produce Statement of Assets and to Appear for Examination and was given a hearing date. At the time of filing, I wasn't aware that the defendant had filed a Motion to Vacate Judgment on the last possible day. I received the Motion to Vacate in the mail several days later. My colleagues might disagree with me. I say do the debtor examination and, if the landlord doesn't show up, get a bench warrant. Interestingly, the landlord filed a motion to vacate and not an appeal. If it were an appeal, then you'd have a brand new trial and your collection efforts would be for naught. It's not certain that the motion to vacate will be granted, so you probably might wish to proceed with attempting to collect on the judgment as quickly as you can.

You can certainly obtain the divorce without the lawyer but that is all you will get - a divorce by default if you can not serve her. As to the children, you will have to know where she is and have her properly served. I don't recommend trying this pro se when children are involved but if you feel you can achieve it that will be your decision. Just remember there are no do overs.

We went through a three and a half year court battle and our divorce was final in August of 2013. He was to start the new child support payments the following month. In September he only sent half a payment and no other money what so ever. He moved to Michigan before our divorce was final and my son and I live in Florida ( I am primary custodian). He quit his job of 12 years and claimed to the judge in August he couldn't afford the child support. She found him to be underemployed and awarded my son child support based on his previous job. I have went to child support enforcement but they say it can take up to another year ( I did not receive the signed order until May of this year (2014) to give to the child support office. My question is can and should I also file for contempt of court for non-payment of child support? I asked child support enforcement if I should do this but the women nastily replied to me "then why do you need us?" I want to do whatever I can to get the child support my son deserves. My ex did not pay much during the divorce either so I have been struggling financially for almost 4 years now. Can I legally go through the child support office and file contempt charges? I also found out just recently because he moved to another state and owes this much in back child support that he is in violation of a federal crime. If you never told him that it was an original, you committed no fraud. I would do nothing. In my opinion, the buyer took a risk and lost. If you didn't lie to him, he has no case. It sounds like you told him, "Here is a photo of what I have. I don't know much about it," and he bought it sight unseen. It falls under what attorneys call "Caveat Emptor", which means "Buyer Beware". A buyer is responsible for making sure he really wants what he purchases, becase you can't just rescind a sale because you changed your mind.

Are you the buyer/borrower or seller?

If you're the buyer, you shouldn't be doing a purchase without a lawyer involved, preferably from before you sign your agreement of purchase. If you're already past that point, you certainly want a lawyer to actually represent you at the closing, because no one else will have your interest at heart, and if you just complete the closing, you may be giving up important rights that could be caught and prevented by your lawyer.

If you are the borrower in a refi, it's less critical, because if it's a residential refi, there's not really much you can change, but you should definitely read all of the documents you are being asked to sign, and make sure that there are no inaccuracies or mistakes. In a residential refi, you have a 3-day period in which you may rescind [undo] the loan, so be sure you have the document for that.

Unless you can find your friend's heirs, and get them to probate the estate and then deed the property to you, you are going to have to file some sort of a combined partition and quiet title action against his estate and heirs. I'm pretty much in agreement with Mr. McCormick. You'll need to get this matter before a judge in the county (Sacramento?) where the property is located, to obtain orders quieting title in your name and, perhaps, allowing you to buy out the interest, if any, of your co-owner's heir(s).

This would require filing a single lawsuit, requesting two, possibly more, types of affirmative relief: quieting title and determining and disposing of any conflicting claims (by partition or otherwise). Writing the suit and getting it served on all necessary parties would be half the battle. Fortunately, it's pretty mechanical, although it may involve such tehniques as serving certain unknown or difficult-to-locate parties by publication of newspaper notices, etc.

After the names of all possible claimants have been determined and the suit has been served on them, the trial and judgment phases are likely to be slow but simple. Your payment of most of the mortgage makes it likely that, even if one or more heirs does respond and show up, the court would award most or all ownership to you (and you could buy out any heir with a valid claim).

There is a basic rule - if you plead it, you must prove it.

If I had to do this, I would go to the hearing, tell the judge that the petitioner was unavailable. I'd then present the judge the signed decree and explain that I was admitting that he the residence requirements had been satisfied, that the marriage was insupportable and that there was no hope of reconciliation.

If that did not work, then the simplest thing I can think of is for him to drop his case and for you to file for divorce. He does not have to show up in court to drop the case. You will then need to file as petitioner and he will need to sign a waiver, etc.

I assume you are asking about whether they can apply to set aside ("expunge") either or both of the convictions? The first hurdle has been crossed: the convictions are more than 5 years old. The remaining hurdles are harder to cross based on your limited information. You cannot set aside a motor vehicle code conviction (example: OWI), or a 'life' felony, or CSC 2nd or 3rd degree convictions. The general rule is that if there is MORE THAN ONE prior criminal (felony or misdemeanor) conviction, ANYwhere (Michigan or elsewhere), then you cannot set aside either of them. Sometimes, that 'second' conviction is something relatively minor, like driving without a license, but it's still a second criminal conviction that blocks eligibility to set aside a more serious crime. Those have been the rules for many years in Michigan. But recently, the eligibility rules were relaxed a tiny bit, so now you can one crime if the second/additional conviction is a "minor offense". There is a very specific definition to "minor offense": it had to be (i) a crime occurring when the person was 17, 18, 19 or 20 years old, AND (ii) had a maximum penalty of 90 days or less, or $1,000 fine or less. So, if the extra conviction when the person was 18 years old was to a 93-day misdemeanor, then he'd still be ineligible because he'd have 2 or more convictions; but if the extra conviction when he was 18 yrs old was for a 90-day misdemeanor, then he'd be eligible to apply because that extra conviction would not count as an "additional" conviction. The 'person' you're asking about should consult with an attorney who handles motions to set aside convictions to make sure that a full criminal history and driving record are obtained so the attorney can research whether the person is truly eligible to apply. The dates of the convictions are also important because the defendant's age may be a critical issue ("minor offense" mentioned above). Also, the punishment level on many crimes changed about 10-15 years ago. Today, there are very few 90-day (or less) misdemeanors out there. Most, like A&B, Impaired Driving 1st Offense, Retail Fraud 3rd Degree (shoplifting), etc. are 93-day misdemeanors. But before those changes were made, most misdemeanors were just of the 90-day max variety ... possibly when your person was convicted. So, talk face to face with an attorney, who should order up the criminal record (see MSP's web site, the iChat link), and a driving record, too.

if you are a U.S. citizen, these are two separate cases. If you are living in the United States, you can file your mother's I-130 petition as soon as you turn 21.

As for the marriage case, you can file for a "fiance visa" for your boyfriend. If it is approved, he can enter the U.S. with immigrant intent & then you must get married within 90 days of his entry. At that point, you can file the I-130 petition for him, along with his I-485 "package", which would allow him to remain in the United States while his case is pending & also provide him with work authorization.

Alternatively, if you get married in Egypt, you can file the I-130 petition for him & then he would be required to apply for his immigrant visa at the U.S. Embassy, which could take several months.

I would recommend seeking legal representation for the marriage case.

Get a lawyer who can assist you with a writ of execution. There is no wage garnishment in PA (I assume the judgment is in PA and that the debtor lives in PA) for most things except unpaid rent. If this is for back rent, then get a lawyer to assist with wage garnishment. If it is some other kind of money judgment, then you will have to see what other kinds of assets the debtor has. If he owns anything free and clear, it can be seized and sold - there is no exemption for land or cars. If he has more than $300 in the bank, you can seize that too.

Judgments on real property are good for 5 years and can be renewed; judgments on personal property are good for 20 years.

Other than that, the debtor is most likely having some financial problems. You have already sued and got a judgment against him and if he has no assets that you can seize and sell, there really is nothing that you can do. If you are decent, maybe you and the debtor can work together - allow him to save and pay you a lump sum or reduce the payments for 6 months, and then see if things are better.

However, if you make a fuss and get a lawyer to execute and he has nothing, then he will save up but he may file bankruptcy (depending on his circumstances) and in that case, chances are that you will get absolutely nothing. So forcing him into bankruptcy is ultimately not in your best interests.

If it was part of a plea deal, that "legal fiction" was almost certainly waived. If someone 18 was convicted of that charge after trial by jury, I'd be very surprised ... if that issue wasn't addressed somehow in court, I'd be shocked but then, stranger things have happened. Talk to the 18 year old's attorney, s/ he would know. Or check the court papers regarding the exact terms under which the plea was accepted. Good luck!

With the engine off and cool simply remove and replace the hose. There should be very little or no pressure in the system with the engine cool - you can remove the radiator cap to make sure.

Keep in mind alot of manufacturers use a quick release style fitting at the heater core. The release tool for these fittings is available at any auto parts store for under 10 bucks. I recommend the little white plastic ones, they always seemed to work better.

On a side note: make sure the line you're disconnecting is for the heater core. The A/C lines run to the evaporator core at the firewall also and they can look similar. Static pressure is usually 90-100 PSI and a large amount of freon discharged can kill you if you inhale it, or burn your skin badly on contact.

He's not going to be able to force that issue any more than he could decide which school they'll attend, so I don't think you have anything to worry about.

If they are actually trying to serve you with Court Process, you should accept it, tell her to mail it or email it, because getting a default is just silly in most cases.

If they are not actually suing you and just threatening suit, they better be ready, willing and able to actually sue you or they have violated the law. What, by the way, is a PPVC out of California. It sounds like either a corporation or a length of plastic pipe.

If both the Bond company and your attorney are "on your side" do you or do they have any evidence to support your position? Being on your side is one thing.. having evidence is another.

If the Bond company "proved" the plaintiff is lying... perhaps you can go into a mediation and the mediator, with that same information, can assist in arriving at a settlement instead of continuing with the litigation. You might even get some money out of it.

I have been seeing a lawyer at a large firm for a little over a year now regarding a workers comp. case. I have seen many doctors regarding my case and the lawyer and I were compiling bills and receipts as he was trying to work on a settlement. I would check in from time to time to see how things were developing with the case and would go in for a face to face meeting every so often. As it turns out after our last meeting a few months ago the lawyer is no longer with the firm and the case has been reassigned to a new lawyer. I spoke with the new lawyer today and he said he had spoken with the insurance company and they gave him a settlement number that was far to low. It turns out that my old lawyer pretty much checked out a while ago because the most recent information regarding my case that the old lawyer sought out to get was in September of 2012. I had met with him at least once since then and spoke to him several times about the case and he told me that we were close to settling, seems to me that I was being duped for quite some time. Now my case is going to take much longer since I'm basically starting over with a new lawyer (same firm so he has some info on the case). Do I just have to deal with it or is the firm accountable for the negligence of its employee?

From what you have written you have no reason to think anyone was negligent. Your case is not starting over--it simply goes on. You have provided no information about how any delay--which generally are part of the process--has injured you. You also not giving any information as to why an attorney would want to intentionally delay his own paycheck--since if the case does not settle, there is no fee for the lawyer.

So unless you show in what specific way the lawyer was negligent, there is nothing in what you have written that evidences any negligence.

Whoever has the right to possession of the children at the time of the birth has the right to decide where the children are during that time period. If the birth occurs during your time with the children then you can do whatever you deem appropriate for the children. If it occurs during your time then it's going to be difficult for you to do anything to stop her from having the children there.

However, the practical issue is that whatever you do is going to affect your children and the parenting relationship you have with the mother. It won't go away. You need to do what you can to reach an agreement now. No agreement means the court order will dictate possession and control at the time of the birth.

If your son is willing to talk to the judge, you have SOME chance that you could prevail on a motion to modify right now, without waiting 6 months. However, your son is right on the edge of the age where judges actually care what his opinion is. Once you've had actual possession for 6 months, it's very hard to lose the lawsuit.

Child support to dad will stop as soon as you win the lawsuit.

If you just informally let your son move in and quit paying child support, you will face contempt of court, but, with a good attorney, you can get out of it (probably) by asking the court for credit for the time your son actually lived with you. The problem is that dad will probably force the son to move back if you quit paying.

Going to court either now (good) or after your son has been with you for 6 months (best) is the only way to end child support for you.

Then later the same day the owner of the tow truck company called me and wanted to come into a side agreement to leave insurance out of it. I hesitated, didn't stop the claim yet, but eventually agreed, however, I put it all in writing in an agreement under my terms, which we eventually both signed. In the agreement I made mention in pretty much each condition I made that the car would be repaired by a body shop and how hewould pay for any and all body shop repair charges the car may require relating to the accident now and in the future. He even agreed to pay rental fees if I rented a car and offered to tow the car to the body shop free of charge. He did come and got the car to tow it, however, he said that because the body shop wasn't open on weekends, he had to take the car to his company and a friend who owns a body shop in Dekalb would come up for the weekend to work on the car for him. That was a Friday. I got the car back the following Monday evening. The same driver brought the car back to me. My 23 yr old son was the only one home, and the driver told him that in fact Hefixed the car and spent all weekend doing it complaining he didn't have time to get to his own work. The work was soooo poor when I got home I called the company right away, but he was gone. They put the wrong model trunk on the car and it didn't close. The light fixtures aren't screwed in and the paint job looked like it was done with can paint spray. I then e-mailed him my concerns. He e-mailed me telling me he would make it right and would send the driver back to pick up the car. I told him I appreciated it, but I felt safer taking it in to a body shop I am familiar with to get an estimate for him. He called me instead of e-mailing and said he would like me to take it in to a body shop he knew of on Friday last week, I said I would try if my schedule allowed, but would still get an estimate from my guy. He apologized for the poor work, however, he lied and said his friend from Dekalb did the work. I told him the driver told us otherwise and he said nothing. I was not able to make it to his body shop due to their hours and mine so I took it in to my shop on Saturday morning. I got the estimate and immediately e-mailed him the fact that I took it in to the shop and told him what the estimate was and offered to send the original estimate. He responded NO, he wants an estimate from his place. My question is, since he didn't follow the terms of our original agreement and I decide to proceed with the insurance claim, can he come back and sue me for breach of contract? Or anything else? And will the insurance cover now that the car has been altered from it original state after the accident?

you need to find a digital gauge cluster wire harness since the plugs are all different. that is the easiest approach. there is no wiring diagram out there to do the swap. you c an put a multimeter on each wire and track each one down one at a time. then go to a electronic parts store to try and find the correct plugs and swap the wires.

An easement won't establish a new property line. All it would do is give X a right to build and maintain his fence on Y's property.

In order to do a lot-line change, considerably more work would be necessary, including an application to the county and a lot more paperwork than you want to deal with.

An easement for the fence seems to be appropriate, and doesn't require county and (probably" lender approvals.

Easements don't need to be surveyed and recorded, but in this case it's probably a good idea; try to find a licensed surveyor who can prepare a description and then attach it to a completed grant of easement form, ready for the neighbor to sign before a notary, then record it.

This would be simpler than doing an actual lot-line adjustment.

I agree completely with Mr. Whipple. A lot-line adjustment is the only way to establish a new property line. An easement cannot be used to establish a new property line, but a lot-line adjustment is far more complicated than it would be worth to solve your problem. Follow Mr. Whipple's advice. Get a surveyor's legal description of the location of the fence line and the portion of your neighbor's property that is inside the fence line. Then go to a title company and pay them a few dollars to turn that into an easement for "exclusive use and occupancy" of the property described in the surveyor's legal description.

Three days ago someone ran over my parked motorcycle in a parking lot. The driver of the car has insurance. However, it looks like my motorcyle may be totaled as the estimated cost of repairs appears to be over the Blue Book value of the motorcycle. This motorcycle was in mint condition. I had planned to keep this for many years to come and owed only $1800.00 on it. If the insurance compnay "totals" the mortorcycle and I receive Blue Book value, this means I have to go backwards - into debt again and basically start over to replace my motorcycle. Is it possible to take the person who ran over my motorcycle to small claims court to recoup the difference between what the insurance company pays and what it will cost me to replace my motorcycle?

No. A driver is only liable for what the vehicle was worth. If it was worth $500 then that is what you get. If it is worth $2000 then that is what you get. It does not matter whether you still owe or not or that you were planning on keeping the bike long after it was paid off and essentially driving for free.

Your options are: (1) if you think the bike can be repaired for less, you can take whatever the insurance compay is offering less what it will cost to buy back the bike for salvage value and get the bike fixed back up (and have a branded title) or; (2) get whatever the total loss figure is and go get an equivalent replacement; or (3) go into debt and get a new vehicle.

That said, you can try to maximize your recovery of what the vehicle is worth by doing some homework. Don't go by just the Blue Book value or figure given to you by the insurer. The insurer's numbers are not realistic and are much lower than real world value. Get the cost of what it will really cost you to go out in the marketplace and find a bike as close as you can get to what the same make, model and mileage and see what it is selling for. That is the figure you need to fight for and get documentation to give to the insurer to justify your demands.

Generally speaking, yes, and you would obviously need to return the buyer's deposit. I welcome the input of others, but the offer probably states that the parties agree to enter into a mutually satisfactory purchase and sale. You may have a problem if you simply refuse to negotiate with the buyer in good faith, or if you pull out of the deal to take another offer. I wouldn't do anything without an attorney reviewing your specific situation. You should have an attorney representing you regardless!
