You should consult an attorney, which means let the attorney look at all the papers, because your summary is insufficient to really explain your situation fully.

What I can tell you, is that it is not that easy to collect on a judgment, which is one of the reasons they give you 20 years to do it. If you were to default for instance, he might obtain a judgment; but if you did not live in New York, he would have to find you or your real estate or bank accounts in order to try to enforce it, and if he were to garnishee your wages, only 10% can be garnished of each check.

Should you settle? Probably if he will release you for $5000, it sounds like a good deal, but make sure the papers are prepared correctly or you will be wasting your money. I would not offer it to him, unless there are settlement negotiations taking place in the lawsuit. He is probably expecting a lot more money, and you may give him the wrong idea by suggesting a settlement, unless you do it correctly.

In probate court there often is a "good old boys" network in which attorneys who normally appear in that court are believed over non-represented beneficiaries unless the evidence is even more than compelling.

Since your mother is on medical assistance, it is important that she does not inherit anything outright, or she most likely will lose her medical assistance. Do not do this on your own. These have to be drafted with care. Get an experienced estate planning attorney that is familar with the Medicaid rules as there are different types of special needs trusts. Depending on your assets, you may need to create a revocable living trust and have the special needs trust for your mother be part of that.

The house may be problematic as it will depend on how the deed is drafted. To avoid having the house go to the nursing home, you and your mother may need to draft a new deed putting the house in your name and she will have to sell you her share of the home. You can refile a suit if it wasn't dismissed with prejudice and if no settlement agreement that released the claim was entered into. You would not be able to sue your employer for negligence anyhow. There should have been a worker's compensation claim filed. You may have a claim of legal malpractice if your attorney failed to pursue your case in a proper fashion. To answer your question: To reinstate a case, there had to have been a dismissal without prejudice (which means you will have 1 year to refile the case--however, you cannot change your theory of liability if the statute has gone).

There may be other circumstances where you may be able to re-instate the case but those are simply very rare and difficult to get around.

If you have your entire file with you and you think the attorney who handled your case was incompetent or failed to follow the right lead, your best option seems to be a legal malpractice claim.

Yes, a suit is a definite possibility, but eBay is not the proper defendant.....you'd have to identify, locate and serve the "seller" .... or possibly the title company.

However, before rushing to sue, I'd suggest starting with a little investigation. Did the money really go to a title company? They are licensed and bonded, and generally put money sent them into segregated escrow accounts. Look at the endorsement on your check. Contact the title company and ask to speak with the escrow officer. Try to determine whether (a) the "title company" is for real, and (b) if it is, did they receive your money, and (c) if they did, at what stage is the escrow?

Possibly you will get your money back from a real escrow at a real title company. Possibly you will get a deed to your timeshare. Unfortunately, it's also possible that the title company is nonexistent and the seller has grabbed your money and it is now somewhere in Ukraine or Mongolia.

Party B has never applied to have the title recorded at the bureau of motor vehicles and it has now been 3 months since party A died. The license plates have expired as well. The executor of Party A's estate has been paying the insurance premiums to keep the insurance valid, but my concern is that the insurance is still not valid and the insurance company would deny any claim made against the policy in addtion to considering it insurance fraud. Is a way around that to have the poicy ownership changed to "the estate of Party A" ? Or should Party B be advised to park the vehicle and/or return it do the executor of the estate until Party B can get the title transferred, pay for new plates, and take out insurance under Party B's own name?

There are laws on this. The new party is required to get a new title and register the car in his or her name. If he/she refuses, then he/she needs to immediatel give the car back to the executor for distribution with the decedent's other property.

The executor in no way should be paying the insurance. Is the buyer added to the policy as driver of the vehicle? If not, there is fraud and if the car is damaged or is in an accident with another vehicle, there will be problems. I hope the executor has protected him or herself by at least having a bill of sale or sosme other document reflecting that the deceased no longer owns the vehicle.

1. If a deed to a married couple says "husband and wife" and nothing more, there is a strong legal presumption that title is held as community property without right of survivorship.

2. Do you need to remove his name? Why would you need to remove his name? In the first place, you probably can't, anyway. I wonder why the thought of removing your husband's name would even occur to you, much less that you would "need" to. Possibly you meant to say your EX-husband? If there has been a divorce, the two of you need to carry out the property settlement agreed to by the two of you, or imposed upon the two of you by the court. If your husband is deceased, you need to go through probate and follow the will, trust or probate court rulings. But you don't mention any death or divorce.

3. Lawyers in general disapprove of making a gift of real estate to children while the parent(s) are alive. For various reasons, many related to federal income taxes on capital gains, it is almost always better for the children to inherit by trust (better) or by will (not quite so good). You can probably find a lawyer that will prepare and fund a simple standardized trust for under a thousand bucks, flat fee. (I don't do them and I'm unsure about the going price).

Bottom line, I think LawGuru could do a better job for you if you'd tell us a little more about the circumstances causing you to ask about removing your husband's name from title.

If you are responsible for the entire rental at the old place, you may be responsible for the rental not paid by former roommates. If the problem is in the rear brakes, the brake drums are out-of-round and need resurfaced. If you feel the tremble in the brake pedal when you brake, then the problem is certainly in the brake system.

You can get them turned but they are going to be thinner than new rotors and whatever caused them to warp last time will happen faster. Where are you getting that they have to "leave" $500? That might be referring to your NC constitutional exemptions. However, you leave out important details - such as when did your account go into default? When was a judgment entered? Where was the judgment entered?When did you move to NC?

The NC exemptions do not apply to Virginia judgments Wachovia/Wells Fargo is in Virginia. I am not licensed in Virginia and you would need to speak to a Virginia attorney regarding the exemptions there. My guess is that this all took place in Virginia and if that is the case, NC law and NC exemptions do not apply just because you live here now. While NC law would apply to things like your car or land or personal property if a Virginia judgment were transferred properly to NC, because the bank accounts are in Virginia and Wachovia/Wells Fargo has branches there, the accounts can be levied there and no transfer is needed.

You should have done something about this long ago when you were first sued. Absent special circumstances, that money is gone. My advice would be to do what you should have done and get a bank account at a small community bank out of state from wherever the judgment was entered or better yet, get an online bank account or debit card so the creditor cannot attach any more of your bank funds. Whatever you do, DO NOT deposit any more funds into the Wachovia/Wells Fargo account and stop any direct deposits into that account now.

There is no initial requirement that the alleged victim give testimony. However, if that witness is properly served a suboena, they can face charges against them for violating that properly served court order. If the alleged victim is not served a subpoena, and does not testify, the defendant can not be convicted (absent very unusual circumtances).

I just got the same bike. The problem with the stripped head is that it's going to be very hard to get traction on the bolt, I've seen a commercial for some type of device used for just such a problem, but I can't recall the name. One thing I have done in the past is to use a standard screwdriver, and push as hard as I can. Make sure you have someone supporting the bike while you do this, or you might take a footpeg to somewhere you'd rather not have it. Hope this helps...

Its the boyfriend's word against yours. The problem is the memo line of the check says "loan." What a small claim's judge will make of that I cannot say.

The statute of limitations in PA is 4 years for most things like contracts or loans assuming that your grandmother and her boyfriend also are in PA. Have you ever received a written demand for repayment?

You leave out many details from your post. Why would a boyfriend of your grandmother choose to make a $3,000 gift to you? If it was a loan, did he ever indicate when you should start repaying it? Why is this only an issue now? What happened that your grndmother is now mad at you? Do you have the money to pay them back?

I don't need an answer but these are all questions that you need to think about these. If your grandmother is truly mad at you, nothing will stop her and her boyfriend from going to the magistrate and suing you in small claims so you had best be prepared how you will argue that it was a gift rather than a loan.

If you receive a written demand then you also need to respond to it reiterating that this was a gift rather than a loan if that is what it was.

Of course, if you can afford to repay it, you may want to think about that even if it was a gift. You can repay the boyfriend and then tell the grandmother and boyfriend that you are not beholden to them any more and want nothing further to do with them. Depending on what was done and signed, her flight may have tolled any statute of limitations.
