In New Mexico can a court appointed guardian of a 5 year old child move with that child to Italy?

Both parents are in jail but the child's mother wants to do whatever is necessary to regain control of her when she gets out.

Answer

The guardian may by statute take custody of the minor and and establish the minor's abode within or without New Mexico. That would include Italy.

Any interested person may petition the court to order a report by the Guardian on the condition of the protected person (the minor).
