As urgent as this feels to you, it is not that much of an emergency to the court that you can get anything on Monday. What you can do is file an amended OSC that includes a request for an order shortening time for hearing and service of the OSC, and for temporary orders until the hearing.

They also sent me something in the mail about a default judgment saying that I failed to respond to their summons. I live in a different city from where the original summons was served. The Plaintiff in this case is Midland Funding.

Midland Funding is a debt buyer. You are correct that they have purchased a delinquent debt from a credit card company that you owe. It is important for you to keep in mind that it no longer matters if you owed the original credit card company....the key to you defense is whether Midland can prove that you owe THEM.

If you were personally served, it doesn't matter that you reside in a different city. If you were not served personally, then you may have a defense.

Once you were served you only had 20 days to answer. If you don't respond, Midland will get a judgment against you...DON'T LET THAT HAPPEN.

Contact a consumer attorney at once, and provide him with the all the documents that you have received, and seek his advice as to what to do next.

There may be an evidentiary problem because the only evidence they have that you own the debt are your credit card statements. But such statements may be hearsay unless Midland can get someone from the original credit card company to authentic them.

Sister spent large amount of my parents' money while living with my mother after our father's death. With my mother's permission, she attended 4 years of professional school (law), never worked, (still doesn't), and traveled the nation and world extensively, including several trips to Paris and Spain. Hawaii and the Orient. While Mother, not an invalid but not safely left alone for long periods, was well cared for, (sister would hire nurses at $5K per weekend, more per week, while she traveled ), by the time Mother passed, there was little left to share, but was distributed between us per my parents' wishes. Did my sister have any obligation to use my mother's money exclusively for my mother? Mother had no idea of my sister's reasons to travel abroad, believing she was seeking work in "International Law" , but in actuality, we learned after mother's death, that sister was pursuing an interest in the paranormal, attending regular meetings of international ufological societies and at my mother's expense, transmitting their proceedings to a small radio audience-for no compensation. Sister also made significant donations to both church and ufological causes/organizations. Sister insists Mother always knew and approved her activities. Mother often complained that "the money is being spent too quickly," but I did not realize the extent to which sister was spending. I believe she squandered, while my mother was alive, what my parents had intended for my mother's care and after her death, for us to share. Can sister be called to any accounting for her expenditures? and reimburse the estate? Or does her insistence that "mother let her do it" consist of a gift my mother willingly gave to her.

If your mother did in fact allow your sister to do these things, then the money was freely given. You sister had no duty to use this money for your mother's sake, based on the facts you've provided.

However, many factors can play into an arrangement between elder parents and adult children. Unfortunately, proving any of them requires having actual proof, which is hard to obtain. It's possible that your mother gave your sister access to the money for convenience only in assisting your mother and as reasonable compensation for doing so. In that instance, some form of trust would have been created where your sister would have a duty to use the money for your mother's benefit. But proving oral trusts is incredibly difficult.

It could also be the case that your mother never REALLY wanted your sister to do these things but your sister put undue influence on your mother via threats, etc. and your mother relented. But, again, unless there is evidence (such as a letter or email from your mother), it is very hard to prove.

I am sorry for the situation you are in and for how your mother may have felt if she was, in fact, taken advantage of. But without some solid proof, there are no laws broken. While your sister may have acted very poorly as a daughter and sister, she may not have violated any legal duties.

If not, he needs to file a Petition to Establish Paternity as soon as possible. Once he does that and gets the mother served, she will need to comply with Florida's Parental Relocation Statute (Chapter 61.13001) if she wants to move the child more than 50 miles.

First we set up payments with the collection agency and then things happened and we could not uphold our payment plan so my default they took out a judgement on him. You NEED to see an attorney ASAP. There is no way a judgment was obtained without service. Now, could service have been faked...possibly, but when the judgment was entered, the Clerk or Judge would ahve to check and make sure service was proper.

If you are saying your husband or someone else living in the home was not served, then there should be no judgment. You should call the Court in the other county to see if a judgment was filed. It is very possible that you are being lied to. If you are, you have an unfair debt collection claim against the collector.

I agree with Attorney Love. If there are questions of service then it may be possible for you to file a Rule 60 motion and have the judgment set aside. However, you cannot pay the judgment off and have the judgment opened. There is also a cost benefit to this - even if you file a motion and succeed in having the judgment vacated, all you will do is put yourself back at square one with a lawsuit. If this is your husband's debt and there are no other defenses (statute of limitations or something else) then the money you would spend attacking the judgment may as well as be spent towards resolution of the judgment. Once the judgment has been resolved, either through settlement or paying, then the creditor will have a duty to mark the judgment as satisfied. If you want to pay the thing off in full, you can directly pay the money to the clerk of court and the clerk will automatically mark the judgment satisfied.

Since you have questions about service though, I suggest that you or your husband go to the county where the judgment was entered and ask to see the court file. The court file should contain the summons, including the return of service, complaint, motion for default/summary judgment and entry of default. Make a copy of the court papers and take these to an attorney for review.

There are some questions - why was your husband sued in one county? Did you or your husband live at the address where the complaint was served? Did you move? If there was a return of service and/or affidavit of service completed by the sheriff, process server or courier, what did it indicate? To be served, the sheriff/process server/courier only has to leave the papers with an adult at the address. The creditor does not have to personally server your husband. In cases where service cannot be effectuated via normal means, a creditor has to get permission from the court to serve via publication.

Who obtained the judgment? What was it for? A credit card or some other type of debt? When was the judgment entered? Have you ever contacted the law firm which obtained the judgment to try to resolve? The answers to these questions may help you decide which way you need to go, i.e, spend money to vacate the judgment or try to resolve the judgment.

I will base this response on the assumption that you have primary custody of your children. I am guessing when you say move, you mean move out of state or another town which would hinder the noncustodial parent from exercising the current parenting schedule. If that is the case then your move could trigger a modification by the other parent. The reason for your move is also important. Keep in mind you are required to provide 30 days notice of your intent to move to the other parent and provide the new address. You need to consult with a family law attorney who can give you the advice you need, including the potential ramifications which may result from a move.

He has no living will, no durable power of attorney the only document in place is the Georgia Advance Directive for Healthcare which my older sister is listed first on, i am second and my older brother is third. I need to know how to gain legal rights to his estate as well as his healthcare decisions due to the fact that he is no longer capable of making decisions on his own, he can not walk, he is completely inmobile and due to the fact my older sister (mentioned above) is on disability and is acting as his caregiver. It sounds like you will need to speak with a lawyer to determine if he needs a guardian and conservator, a big step, and also to have him speak to a lawyer to determine if he is competent to still make a will and POA.

Your father already has what sounds like a living will and healthcare directive. The way for you to gain control is if your father chooses and if he is still mentally competent then he can revoke the existing health care directive and make a new one.

However, these decisions are for your father to make not you. If your father is no longer mentally competent, then a revocation and new financial and health care power of attorney is not going to work. In such case, you can apply to the court in which your father resides to become his financial and/or healthcare guardian. GA calls financial guardians conservators. A healthcare guardian would be able to make healthcare decisions for your father. To obtain guardianship, you cannot just show that you are concerned because your sister is disabled. You have to prove that your father is mentally incompetent to make decisions for himself and that you are the best person to be in charge of such decisions.

Conservatorship/guardianship is a legal proceeding. There will be a hearing at which evidence is presented. Medical evidence of incompetency will have to be proven and your father definitely and possibly sister may be parties and called to testify. To best maximize any chance for success, I suggest that you consult with an elder law attorney who practices in the area of guardianships for adults in the county in which your father resides.

If your father is mentally competent, then the attorney may be able to draft the financial and healthcare powers. Some attorneys will even come and visit your father if he is bedridden but mentally competent. An ethical attorney will want to meet privately with your father and discus your father's wishes with him.

It might also be wise for you, your father and sister, before you call an attorney, to sit down and have a family meeting and air your concerns. Your primary concern should be on the well-being of your father and seeing that his needs are met and determine how best to effectuate this. However, if there is no way that your father is mentally competent, then I would call a meeting of your siblings if you are on relatively good terms with them. I would discuss the need for a guardianship for healthcare and finances for your father. It may be that one person can be a healthcare guardian and the other a conservator over finances and real property. The healthcare guardian should be someone who lives with or near your father and who is capable of caring for his healthcare needs. The conservator should be someone with financial common sense who will be diligent about managing your father's money/property and paying his bills. Having a family meeting will go a long way towards reducing legal expenses. However, if its not possible, then talk to the elder care attorney on your own.

I assume they are now month-to-month. If you don't want them there, slowly raise their rent until they leave. The whole purpose of doing a year lease is to benefit the lease holder with assurance that they won't have their rents raised. (At least that's what your tenant needs to know.) Simply explain to them that the slow rental season is coming up and it will be hard for you to find a new renter so you must cover those months when this renter will be gone and no one will be in there so you have to raise the rent. If they want to sign a new lease you can assure them a low rent for the next year.

Most likely because your hearing presented some complicated issues for him to consider and they wanted to ensure they were legally correct in their decision. You should expect an answer within 60 days of the hearing typically. Judges usually make decisions quicker than that though, but 30 days is not unheard of to hear an answer through the mail of the courts order.

So you're saying you signed the lease and handed it over to the landlord with $1500, and now the landlord won't sign and return the lease until your check(s) (presumably for the security deposit and first month's rent) clear.

OK, well, technically even though she may have prepared the lease she is viewing your having signed and sent it in as an offer to lease from her, and she is conditioning acceptance of the paper lease, her signing and returning it, on clearance of funds. Effectively she is saying that clearance of funds will be acceptance because she apparently is depositing the money before returning a lease signed by her as landlord, which is the customary way of accepting a lease "offer".

You can "revoke" the offer at any time up and until acceptance which, technically, would be acceptance of funds according to what she is saying, but more in line with custom would be before she returns a signed lease to you. Proving who did what and when would be the issue in a fight over the money and lease later, so you may want an attorney to handle the revocation.

Then again, you don't say when you gave her the lease with money, or how long it's been, or when she deposited the checks.... so there's a good chance the checks have already cleared, and about the only way you could revoke fully would be to stop pay too, which also may be too late. There are a few details that you omitted. Why is the tax collector calling you? Were you a co-owner or co-signer on the finance contract? Why is it that you think the other person is responsible? Whjy are they also on the bill?

If you were both registered owners of the car then you are equally liable for the tax. However, the taxing authority wants the money and they are not obligated to just get 50% from you. My advice is to pay the tax and then go after the other person for contibution for their share. What I would do is send them a letter via UPS/FedEx and get signature confirmation. It costs more but too many people play games with certified mail and refuse it.

Make a demand in the letter for their share of the tax. Indicate that if you do not receive it in 30 days, that you will pay and seek contribution. If the amount is less than $5,000 you can sue the other person in small claims assuming that he/she lives in in NC. You would sue in the county where the other person lives.

Is your brother a minor (under age 18) or an adult? Has your mother been formally appointed as his legal guardian if he is over 18?

If the answer is yes, then upon her death, guardianship does not transfer to the next of kin. A new guardian would have to be appointed as a successor.

If your mother is not the guardian, then is she only a payee for Social Security purposes? In that case, if your mother died then your brother would have to assign a new payee. But being a payee does not allow the agent to make decisions for someone.

I think that if you are concerned then you probably ought to have a discussion with your mother to see what has been done and make some plans for succession planning. You also should talk to an elder care lawyer as they are most familiar with these types of situations.

I don't know what assets your mother has but she may also want to set up a special needs trust to care for your brother. In such case, she needs to see an estate planning lawyer for that.

The mortgage company never issued a notice to vacate or serve eviction papers and even tho I had moved out I was in and out of the house on a regular basis, even communicating regularly with them and I told them I would be completely moved out and all my personal property removed by Dec 3rd. I was preparing to hold an estate sale and had just begun to move things out when the bank changed the locks, an incident i did not discover had occurred until this past Thursday morning when i went to the house to conduct last minute preparations for my estate sale (which was to be held yesterday and today). Upon arriving at the house Thursday morning I discovered Every last item of personal property had been removed and taken to a landfill. 17 years worth beautiful furnishings and memories including photos, birth certificates, etc. I am devastated! And wondering what legal right I have to sue for the thousands of dollars worth of furniture that I feel was stolen from me? As I said, they knew I was technically still occupying the house; they did not serve me eviction notice; I was regular contact with the mortgage company and they KNEW And gave consent for me to be there until Dec 3rd. They said that because I had turned off all the utilities and the locks had been changed for 1 week and I did not contact them they considered it abandoned, even tho they said and knew I would be there until dec 3rd. Do I have any recourse? Please help!

I think you are going to have a difficult time with this. Very likely, the order confirming the sale provided 30 days for possession and you should have taken better steps to cover yourself after that date. You may be able to make something out of the additional communications you had, but the burden to make the case is going to be on you. I reside in florida. as of late we have received a lot of rain and I started getting leaks of water in the truck. my work schedule and the days of operation at the dealer didn't match up.
