Can a person still serve a sentence for a parole voliation even though their parole is up?



Answer

A person does not get credit toward their sentence while on parole if they violate. So, if person gets 10 years and is released after 5, he has 5 years he still owes the state in custody but the state has decided to let him be out for the remaining 5 as long as he does as he is supposed to do. If the person gets finished with the 5 and then does another crime, the original case is over; he cannot be incarcerated for that old case because the time expired. BUT, if the new crime was committed say after the person was on the street for 4 years 6 months and he gets a blue warrant (parole violation warrant) before the 5 years expires, then he can be sent back to prison for the full 5. He does not get street credit.
