if a minor is driving a car with a passenger on parole can a officer pull them over with no traffic violation committed and then take juvenile onto backroad to search car and then take them to the police station without notifying their parents? and then file a case on them three months later exactly ten days after their 18th birthday.



Answer

The age at the time of the alleged crime is what controls the juvenile court or regular adult court having the case initially. The police need a reason to pull over a vehicle and will indicate the reason in the police report. It is unlikely they knew the passenger was on parole before the traffic stop and the minor/now adult that had a case filed must be charged with something in the case. The three months it took for filing is not that unusual for misdemeanor charges when the person is not detained/arrested.
