Question

I am a cosigner on an auto loan in St. Louis,MO for my stepdaughter. The car was repossessed (at the same time I lost my home to foreclosure). I am being sued by the creditor (along with my stepdaughter). My "soon to be ex-wife" also signed as a cosigner but she is not being sued. Why? She is the only one that has a good paying job. Confused.

Answer

The plaintif can decide who to sue. Under the facts you described, it appears thay you could bring the mother in as another defendant, or sue her for contribution. You should also discuss this suit with yrou divorce attorney, as the debt on the stepdaughter's car could be addressed in theg property/debt division between you and the mother.

Good luck
