Question

My ex fiancee and I opened a joint credit card account and he was the only one using it and is paying the bill. We plan to close it once the balance is paid in full. We have a promissory note that we drew up stating that he would not make anymore charges and will pay the monthly payments until the balance is complete. If he defaults can I take him to court for the money.

Answer

If the document is properly worded, and we haven't seen it, yes. But the creditor can sue you if he stops paying.
