Question

If you have a finalized divorce decree with children. One parent was named Sole Managing Conservator and the other as Possessory Conservator. The rights are all listed under each. If it list that the Possessory has the right only to confer with the other parent who has sole and to take the child to emergency care only. Can the possessory still go to the school and get the child or do things at the school if it doesn't state he/she can as it does the sole?

Answer

You raise two issues:

1. Can the PC "get the child" from school? That depends on the possession and access schedule, not the conservatorship rights. A parent can go to school and "get the child" on days when that parent has the exclusive right of possession of the child.

2. Can the PC "do things at the school?" If you mean attend events, then yes, the PC can attend events unless their is specific language prohibiting that. But if you mean make educational decisions such as choose classes, then no.
