had car accident 11/30/12,had gun on me,had expired gun lisence,everytime I ask for its return the only answer I get is its under investigation. Should it be returned to me?

Thats the least of your problems. Carrying a unlicensed gun is a crime. You'll never see that gun again and I hope you are not charged. If you are, say nothing and get a good local attorney to assist you.
