Question

Parents own their home outright (valued at about $116,000), they owe about $55,000 in credit card debt. They were told that they couldn't file chapter 7, but would have to file chapter 13...is that right? I know they are allowed $40,000 equity due to the Utah Homestead Act, but would they be forced to sell home to pay off creditors if they did a Chapter 7?

Answer

Here is the problem.

116,000

-40,000

= 76,000 in available equity that should go to creditors.

In Ch 13 they would not need to sell the house, but their excess income above a court approved budget for 3 years would be applied to their unsecured debt - and they keep the house.

What is the expectation of child support from a father that is a high school student?

Question

What is the expectation of child support from a father that is a high school student?

Answer

I'd be calling a family law attorney immediately!

Now that these "children" are now the parents of a child, it is complex.

He will be expected to pay minimum wage child support. He needs to get a job.

He will get short frequent visits with the baby.

Hire an attorney!

in a civil federal lawsuit...going to send out interrogatories for discovery informantion..my question is "How is that served?' by certified mail or process server....

Answer

Usually you do just a certificate of mailing by regular mail or a receipt of copy delivery by a messenger service. No need for a process server as the address should already be part of the court record.

We have substantial experience handling these types of cases and reasonable fees, however, we would need some more information before making a complete and proper determination. Question

Hello, If two sisters own a house and one dies does the other sister have to pay an inheritance tax on the house since she will now be the owner. Thank You.

Answer

you will need to talk to an attorney and give the attorney the documents, to get an answer you can rely on.

Answer

I depends on how title to the property is held in the deed and on State law. Estate tax is a federal tax levied on the estate as a whole. Inheritance tax is a State tax that depends on the residence of the beneficiary. Lawyers who handle estates can tell you what the laws are for each State.
