Question

I'm renting a house from a friend that belongs to his mother, I signed a lease between me and my friend, lease is good till may next year, I've been here almost three years, now his mom is trying to raise the rent, she is saying the lease her son wrote is not valid and wants to evict me and my family, what can I do? Thanks

Answer

Why is she claiming it is not valid? You need to pin her down. If she says that he had no right to sign a lease with you, then you can win on the basis that he had obstentable [legally apparent] authority to do so and her letting you live there for three years means she concurred in it and is estopped from now raising an issue that should have been brought up years ago. rent can not be raised while the lease is still valid as it is a contract stating that if you pay $X you get to stay there.

Question

A family friend has a 16 year old son who is on probation he left home and is staying with his girlfriend and her mother. His mom has tried to get him to come home (for 2-3 months) but he refuses and says he will run away, he is smoking marijuana, allowed to drive his girlfriends moms car without a license, and about to leave the state with his girlfriend and her mom for a week long vacation. The mother doesn't want to call the police because she doesn't want him to go to jail because she thinks he will "hate her" what can I do to help this family while staying as annonymous as possible?

Answer

Nothing. This is mother and father's business, and if they won't do anything, you have no power to do anything.

What does wax on wax off mean?

What does wax on wax off mean?
This was a phrase from the movie KARATE KID. The teacher taught the kid how to do major karate moves by waxing the car. He used his left hand to put on wax in one direction and used the other hand in the other direction to remove the wax. When the kid questioned the master that he wasnt being taught karate the master asked him to show him WAX ON WAX OFF.
The technique is known as the Kagite uke or circle block. It is a very effective block that provides a good lead in for follow on techniques.

Um...That may be true but...
Okay, so maybe they didn't mean it like this but having been one of those TV writers myself, who used to love to slip in double meaning in otherwise PG shows this just hit me the other day:
Wax On/Wax Off...
Keep saying it to yourself and think about the second part.
Maybe I'm just a twisted soul but...

Question

Hi,

I have a written contract with a local dealership that states I have free oil changes for the life of my car as long as I am the owner (it's not transferable to a new owner of a car). The dealership claims they are under new owners so they do not have to honor the contract I have but they this use the same name, logo, etc. that is present on the contract and they did not send out a notice to the owners with this service. If they do not honor the contract do I have a good lawsuit case if so what would be the monetary amount I should ask for?

Answer

I would sue the new owners and the old owners in small claims court. I would ask the court to find that ONE of them is liable to you for free oil changes for life. If you want money, I'd ask for an amount equal to

(([Expected Mileage of Car When you Sell it] - [current mileage]) / 3500) * [Price of Oil Change]

and add attorney's fees to that.

Someone probably owes you free oil changes!!

Can my attorney hold money from my settlement in case the lien holder wants money from my settlement?

Question

Can my attorney hold money from my settlement in case the lien holder wants money from my settlement?

Answer

My general response would be, Yes. If someone has a lien or even a potential lien on the settlement, then the attorney should hold the amount necessary to satisfy the lien but can distribute the rest. To get a real answer, an attorney would need to see documentation of the lien claim, because if there is not a valid lien, but merely a creditor, then the attorney may not be obligated to hold the money.

Answer

I agree with Mr. Feldman. Additionally, your contract most likely allows your lawyer to withhold settlement proceeds in order to pay lienholders.

Answer

He MUST hold lien claims until they are resolved or paid. There are limits on how much of your settlement can be held for this. Talk to your attorney or hire counsel for assistance. .

Answer

The attorney has an ethical obligation to hold money from a settlement that a third party has a lien on.
