You should consult with a lawyer, and probably have an expert conduct an examination of your apartment to determine the type of mold present, whether it represents a danger to your health, and what would be involved in remediating (getting rid of) the mold. If it is determined that the mold is hazardous, then a court could either order the landlord to remove the mold, relieve you of your obligation to pay rent until the situation is fixed, or void the lease.

He has decided he is not satified with portions of the project and wants not only the final check back but the entire projects balance. What are my rights? Never had this happen and been in business for over 25 years.

A lot will depend on whether the customer attempts to stop payment on the check.
1. If you gave a final lien waiver in exchange for the final check and believe your work was ok, then you have a perfect right to attempt to negotiate the check and if the customer stops payment you still have your lien rights but then you know you wind up having to foreclose and settle (unless you can win).
2. You can accede to the customer's request (but then you ought to get back any final lien waiver) and consider liening the job to protect your rights. A lien waiver not supported by payment won't be valid.

Mr. Messutta is entirely correct, though I would emphasize that you are perfectly within your rights to atttempt to cash or deposit the check, and I think you ought to do that. This will create a win-win for you, since either the check will clear (and you will get your money) or the check will bounce, and you will have a stronger claim against the customer, because the customer is liable to you for non-payment of the check, in addition to being liable to you for your work and materials. You cannot collect twice, but it's always good to have two paths to success, and the customer's liability to you for writing you a bad check is cleaner and easier to prove, may give you a slightly larger recovery, and may not require you to foreclose. Rather, you may be able to collect on the check in a simpler manner. Most importantly, ascertain the deadline to lien the job, and unless you are absolutely sure the check has cleared as that date approaches, properly lien up the job, hiring a lawyer to do so, unless you are skilled at asserting liens, which is complicated.

In most cases, the driver and passenger can be represented by the same attorney, but your brother and the parent or guardian of the child will both have to waive any conflict of interest. That shouldn't be a problem if your brother was not at fault in the collision. In Florida, there is a presumption in a rear-end collision that the rear vehicle is at fault. They cannot evict to sell. That is illegal under both California law, and especially under San Francisco's rent control ordinances. They do have to give notice of every entry, but under Civil Code section 1954(d)(2), they can give one written notice that the house is for sale and will be shown for the next 120 days on further verbal notice. Thereafter they only need to give the 24-hour entry notice verbally for showings. They must, however, leave written evidence of each entry when it occurs. Most commonly this is done by the real estate agent leaving their card in a conspicuous location. During this time, entry for other purposes related to the sale, such as inspections, repairs, etc., must still be in writing.

Maybe, maybe not. It depends on what the contract says and on precisely what happened.
Mr. Wallin wrote that the lawyer's experience and the complexity of the case will also be factors. They might be, but only if the contract is ambiguous. Most are pretty clear about questions like this one. If the contract is ambiguous,the lawyer might only be entitled to a "reasonable" fee. The factors Mr. Wallin mentions would help determine what's reasonable. But if the contract is clear, you likely wouldn't get to that point.

My daughter screamed and cried for me not to let her mom take her. That is the last time ive seen her.They lie about where they are at. Its the boy shes with who doesnt like me because of his ex is my girlfriend so he keeps her from allowing me to see her. When they fight she will call me to let me see her then he steps in and puts a stop to it. I fear because he knows she will tell on him. Whether thats the case or not I dont know but I just want to see her. I miss her and I want to make sure shes ok and get my visitation already ordered by a judge. Im worried about my daughter. She loves me too, and is kept away from me when she wants to see me ive heard out of her own mouth over the phone. She was so excited to come see me. The police and DFACS are right, you do need an attorney to assist you in navigating the child custody laws. I would be glad to assist you on a sliding scale basis if you contact my office. Additionally, you can make seek criminal prosecution in the matter, once you have probable cause. An attorney can assist you in preparing the warrant application, and in seeking criminal charges where appropriate. You need to be proactive in protecting your child, you cannot afford to wait another year.

Your posting is odd. If yoy paid off thw debt, then a dusmissal or Satisfaction shoukd have been filed. If deputues.actually came to evict yoy, then the Court did not know that you had paidthe debt. A landlord (nir their employees) can serve the evuction Order. You might need to hire an attorney to investigste the facts and dicunents if this matter.

Sounds hinkey to me. If the VA does not have good title to the property, then your purchase could be invalid. A quitclaim deed conveys only what the "grantor" owns, and if the grantor's title is fouled up somehow in the foreclosure process, then you get the same fouled up title.

Also, the Recorder may require you to complete and provide a form that goes to the Medicaid Recovery Administrator to determine if the Administrator has a claim to recover any Medicaid she received. This is important even if she did not receive Medicaid. Finally, there is an Ohio estate tax form that needs to be prepared and filed certifying that no Ohio estate tax is due (assuming her estate is under $338,333.) The recording fees would be under $100 and the lawyer fees should be no more than $500, assuming this is all that needs to be accomplished.

I can't predict what the judge/hearing officer will do, but you are allowed to put on evidence that you were not reckless driving. They often cite people for this charge when there is "screaching tires". If you can convincingly tell the judge you were not trying to "punch it" for fun or were not racing, but rather, the vehicle has a v8, a powerful engine and you mistakingly pushed the pedal too hard, the Court may dismiss the case. If you proceed to a trial before the hearing officer/judge, you don't need to be nervous! There is no jury in these cases...you simply stand in front of the bench and tell your side. You can bring a witness if you want. The officer should be there to tell his/her side.
For years I have handled traffic citation cases, among others, and normally, I advise clients not to set the matter for trial, but let us plead No Contest and ask the Court to "withhold adjudication of guilt". If the Court withholds adjudication, this means there is NO conviction. Court costs are usually ordered in those dispositions. It is usually the amount on the back of the ticket. When I represent a very young driver, the Court almost always reduces the amount of the court costs. Rust is somewhere between a metal and non-metal. Its property introduces new atoms and elements, in which forms new chemicals with a changing electron interaction. And if you're curious, electrons have primary roles in generating magnectism.

On the alternative - if neither of you have filed papers, then take your children to your mother's house and file in that county ASAP for a divorce. There are protections for you as the law has changed in this area. I do understand that you can claim the mortgage interest credit on these with the appropriate documentation, if it even helps you (remember your itemized deductions need to be more than your standard deduction to be worth claiming). Unfortunately, you need to have your agreement reviewed to see if it does protect you. You should also record the contract with the register of deeds to put all other parties on notice of your interest.

This is regarding municpal law. I recieved my utilities bill for water, sewer and garbage. The village where I live charges 65% of my water bill to figure out the sewer bill. About a year ago the village implemented a capital improvement fee for a well they are building. When I questioned the city administrator about the bill she stated the combine the water usage portion with the capital improvement fee. They take 65% of that total now to figure sewer. I would like to know the legalities of this. To me this is wrong. I am not questioning the improvement fee however they are also getting 65% of the fee as well. What are your thoughts?

65% is just an estimate because the village is supposed to break out these costs when the reality is that the water and sewer is probably under one budget, and doesn't really reflect true cost. When you say "administrator" do you mean clerk? You should feel free to talk to the finance director, or manager, or whoever you feel finally gives you a straight answer before thinking you're being taken. When you do you may find that this was a way of avoiding a property tax special assessment.

You or your brother or other sibling should contact the probate court in the city or county in Virginia where your father died and ask to check the probate records to see if an administrator was ever appointed by the court for your father's estate(assuming there was no will) and whether such an estate was actually opened.
If not, then one of you should apply to the court to be appointed administrator of the estate who will then have the necessary legal authority to confront your stepmother
as to what has happened to your father's property and you should then be in a position to begin taking the steps necessary to retrieve at least
some of it for your father's rightful beneficiaries (other than the stepmother), which should include you as well as your siblings.

I am curious as to why a convicted person may not be ordered to an AA/NA program, but an individual who has not been convicted of a crime can be.

I disagree. Driving a vehicle with .17 BAC is really irresponsible and you're lucky somebody didn't get killed. The court wants you to find out what is the problem, you can't not drink and drive. If you can come up with what you consider to be a non-religious alcohol program, ask the judge or probation officer to let you participate.

As to the loud noise, call the police.
As to mold, cal your county or city code enforcement, who will probably cite the landlord and ticket them to force repairs.

You have options, but every one of them comes with a cost. You could insist that all communications go through some neutral intermediary, either a personal acquaintance or a lawyer, or a service such as "Our Family Wizard"; if refused, you could ask the court to order that.
You could request that all communications be limited to child issues, backed up with a request for consent to tape all communications (and you don't need consent for face-to-face taping), with the same fall-back.
You could even ask to modify the custodial schedule to limit or eliminate inter-personal interaction.
All of these could lead to escalation, of course, or reprisals. So it all depends on how important it is to you, and what you are willing to do to resolve it.

First off, it is up to the state to prove you guilty, not up to you to prove your innocence.
As to how you plead, frankly, that depends on what the DA has to offer. Your record and the facts of the incident will influence negotiations.
That being said, if you do not wish to entertain plea offers, or if the DA makes a bad one, plead not guilty.
From a practical standpoint, you need to gather statements from witnesses (and the fewer that are from friends and cronies the better) that give a clear view of what happened. Given that the other party started the physical actions by hair pulling, you possess a valid self defense claim. Colorado law allows you to use the amount of force you feel reasonably necessary to stop the use of force against yourself.

He told me that he hadnt paid his attorney and that they never submitted a decree for the judge to sign. I called several times the following months, just to check his story and the court clerk told me the same thing. That a decree had never been submitted for the judge to sign, so we were still married. I found out a week ago that he did finalize the divorce in jan of 2010. For two years we have been divorced and he never told anyone.Im in shock and dont even know where to start. Im a stay at home mom of our two kids and was led to believe that we never divorced. I found out the decree was sent to our old address. What do I do? IT says i have supervised visitation.

Wow. I can see how you might be a little thrown by that. I'm curious as to how you found this out now. Are you sure your husband knew about the divorce, or did his attorney maybe just go ahead and file it for him, so it was a surprise to him as well?
You're a month too late to be able to file a bill of review on this (which would basically contest the decree on the grounds that you did not have the opportunity to participate at the hearing and through no fault of your own were unaware that the divorce had been granted at a time when you could have filed a motion for new trial or appealed it). I think it's at least possible that a good argument could be made that despite the divorce, the two of you have had a common-law marriage since whenever it was you got back together, if it's true that everyone including you believed that you were still married. Remarriage would automatically terminate whatever child support obligation you had, though I don't believe it would do the same with the custody/visitation end of things. However, that should have a provision saying that it's subject to agreement of the parties anyway. If everything's okay between the two of you now, there may be a means by which you can ask the court to terminate the SAPCR order (I've never heard of that being done, but I don't see why you couldn't ask for it here).
If things are NOT okay now, though, you're going to need to go back to court and ask for the custody and visitation provisions to be modified, and for a new support order to be put in place consistent with that (if you've been at home with the kids for the last two years, and everything's been okay, it's hard to see how either him having custody or the supervised visitation was appropriate to begin with). You can at the same time ask the court to issue a declaratory judgment as to the issue of whether the two of you now have a common-law marriage, since if you do, and there are now problems, you may need to file for divorce again. Good luck sorting this mess out.

If you have a properly granted Durable Power of Attorney, it survives them going into a rest home. It is unclear, however, whether you can rent the house. I don't understand what "The house is not bought yet" means. Any POA only gives you the power to do what the person could do themselves. So if you mean the person who gave the DPOA does not own the house, then they cannot rent it out, and therefore neither can you. If the person who gave the DPOA is a tenant, then you might be able to sublet it, but that would depend on the lease, rental agreement, or other arrangement with the actual owner of the property. Bottom Line: the DPOA gives you the ability to do anything the person who gave it to you could legally do, but ONLY what they have a legal right to do.

I imagine that you mean that your friend bought a home, but that the home loan isn't fully paid off yet. If that's the case, and if your friend did not transfer the property to a trust in order to avoid probate on his death, then you, as agent under the DPOA, can execute a lease to rent the property out to tenants.
If, however, the property is in a trust, only the trustee (or successor trustee if your friend is incapacitated) can sign a lease.

The main sewer drain pipe is in the other half of the duplex. Our drain in the basement as been backing up with water frequently, we have had plumbers out to snake the drain twice now, it temporarily helps the problem but after a few weeks we seem to have the same issue. They told us this is because the main problem is probably a blockage on the other unit.
Last night, our neighbors knocked on our door and had said their basement was flooding with actual sewage. They had previously smelled sewage but their landlord told them it was "normal is old houses" Our drain just seems to be backing up with water. They contacted their landlords who said they will send out a plumber to snake. (in my opinion, this issue seems to be a bit larger than what could just be fixed with a snake). What i'm wondering is, whos legal responsibility is it for a shared drain? No one disclosed the fact that we didn't have a completely independent unit when we purchased the home, there was nothing on the sellers disclosure about sewage problems or standing water in the basement, and this certainly isn't a problem that just started occurring the DAY we moved in. I'm at a loss, and would just like to know a bit more about where we stand before I contact the management company that sold us this property.

The problems you raise would normally be covered by some kind of declaration or easement recorded in land records and governing the rights and obligations of the owners. If your half of the duplex was sold without each of the units having been legally created as separate real estate and proper documentation as to ownership rights, your purchase may not have been valid.
Some issues should have been disclosed in the Seller's Property Disclosure Statement, required by law, and by any inspections you should have had done. If those matters were facts and were intentionally not disclosed, you may have a claim against the seller.
Was the Management Company the legal owner of the duplex? If not, was the deed signed by the legal owner? If you purchased title insurance at the time of the purchase, it may insure some of the issues, such as valid title to real property legally created, consisting of the one-half of the duplex, and that the seller was the legal owner without any claims by others to title or an interest in the property.
Were you represented at the settlement? By a lawyer?

marriage ending in divorce after 10 yrs. during the marriage husband worked for ilinois dept of corrections and was injured on the job and has been receiving occupational disability for the past 4 years. in this settlement he is to receive monthly benefit until the year of 2023 when they will officially retire him. i have been told both ways that i am and am not entitled to part of this monthly settlement he receives and need someone that can tell me for sure which way it is. please help me clarify this. thanks!

Hello. Benefits due to injury on the job can be a complicated subject in terms of whether it constitutes marital property. Better get more than one opinion on this. If in doubt, you may want to go to trial on this issue and let the judge decide.

I just found out that my general contractor is not paying the subcontractors who are working on my house and they are not finishing the work. As the homeowner, I only have one final payment left to the GC,and doubt it's enough to cover all that he still owes the subcontractors. Should I pay the subcontractors directly and deduct it from the final GC payment, even though my only contract is with the GC? Should I offer to pay the subcontractors so that they will finish their part of the work? I live in Florida, it's 90+ degrees everyday. I still don't have a/c or electric finished and the contract states the job should have been finished in April, but it's now July. PLEASE ADVISE!

If they are not paid by the GC, they can file liens. You should only pay the GC, not the subs.

They can sue you and garnish your wages. They have six years from the date of your last payment to sue you. Many times they just threaten but for $15,000,they will probably sue.

I gave my money to my brothers to down the house and every year, I paid mortgage with them. Right now, my house was paid off (discharge) loan already. How will I add my name to the deed as co-owner of the house with my brothers? When I asked my brother to add my name on their deed, my brother explained for me that if he add my name to their deed, I need to pay tax for the value of house $300,000.00 not $110,000.00 as when we purchased it over 15 years ago. In May of 2011, I bought a house in Volusia for cash (but now have a HELOC on it). In October of 2011, (five months later) my only child married. At the time of purchase, I neglected to do something about making him the sole beneficiary of the house should I pass away, and thus, in the event of his possible divorce, his wife may now benefit from said real estate. I should note that they live in the house with me (we live in separate quarters) and the relationship is fine, but I still would like to find a way to ensure that only my son receives ownership of the house. To simply answer part of your question, there is no way to "retroactively" add him to the ownership of the house/property. If you were to add him now it still would not prevent him from adding someone else in the future after you are deceased. Further, there could be negative tax implications for adding him to the deed while you are still alive, because he would then have the same tax basis as you, so that if the house appreciates significantly in the future he may not enjoy the gain without having to pay the IRS. With that said, your question may not be as simple as you think.
You may want to consult with an estate planning lawyer for more specific answers and guidance. However, generally speaking, proceeds from an inheritance are exempt from the marital property estate in the event of a divorce. Despite that, there are several ways a spouse could lay claim to an inheritance in the event of a divorce. In the case of real property/home, if the non-inheriting spouse contributes to the upkeep, maintenance, taxes, insurance, etc. then he/she may claim some interest in the property at the time of the divorce. At the very least they may be entitled to reimbursement for their contributions during the marriage if the amounts an be identified. Also, like I mentioned previously, your son could add his spouse to the deed at any time after your death which would convey an interest to his spouse.
There are additional issues related to ownership that could arise if he were to die without a will, or if he has minor children at the time of his death and the property is his homestead. Before you act you would be best served by scheduling an in person consult with an estate planning attorney in your area and pay a consultation fee for answers and guidance. You may also want to take this opportunity to update your estate planning documents as well. There are ways to obtain the outcome you seem to want, such as Trusts of various types, but it will take more than a simple will and you may not want to incur the expense and headache involved. Again, a consultation with an experienced estate lawyer will probably provide you with many answers to your questions.
