Question

Can unpaid pay day loans be charged off in a bankruptcy, and can creditor contact my employer and tell them that there are fraud charges against me. I have never been contacted and they claim I will be served at work.

Answer

Chapter 7 bankruptcy will discharge payday loans. The loan must be listed as one of the debts in the bankruptcy filing papers. You should not take out new payday loans once you have contacted a bankruptcy attorney. Doing so shows intent to act fraudulently
