i have mold in my apartment i just moved into. Can i break the lease and move out?

Without the landlord's consent or a Court Order, you cannot simply move out. You should consult with a lawyer, and probably have an expert conduct an examination of your apartment to determine the type of mold present, whether it represents a danger to your health, and what would be involved in remediating (getting rid of) the mold. If it is determined that the mold is hazardous, then a court could either order the landlord to remove the mold, relieve you of your obligation to pay rent until the situation is fixed, or void the lease.
