Question

California criminal case if lawyer fees are paid 7, 500 for possible trial and then gets resolved.(NO TRIAL) does any of this fee get refunded?

Answer

It depends on several factors...1) The precise language of the retainer 2) The experience of the attorney. 3). THE complexity of the case....and other factors. I hope that helps.......David Wallin

Answer

Maybe, maybe not. It depends on what the contract says and on precisely what happened.

Mr. Wallin wrote that the lawyer's experience and the complexity of the case will also be factors. They might be, but only if the contract is ambiguous. Most are pretty clear about questions like this one. If the contract is ambiguous, the lawyer might only be entitled to a "reasonable" fee. The factors Mr. Wallin mentions would help determine what's reasonable. But if the contract is clear, you likely wouldn't get to that point.

Good luck.

Answer

It depends on the retainer agreement with the attorney.
