My 37 yr old daughter has an 11 yr old son her and the father were never married she is pregnant now and we wonder if the 11 yr olds dad can try to take custody

You do not tell us whether the father has any judicially determined custody rights. The facts included in your question do not really give an attorney enough info to provide much of a response. I sppose that anyone can try to obtain custody, but the facts you give us do not leave me with the impression that the father would prevail.
