Question

At a California Single-Family-Residence, with a swim pool in the back yard...

at the rear of the property is a 6-foot-tall block wall, on the property line,

and on the other side of that block wall is a 100-unit condo-complex.

On that other side are some now 100-foot-tall trees that drop leaves into my swim pool.

The HOA for the condos says that they cannot afford to cut down the trees.

I want to keep my pool clean. What are my options?

Can I cut any and all parts of the trees that are directly straight up from the block wall?

Is that ALL that I am allowed to do?

I'm pretty durn sure that I'm allowed to do that,

but it won't solve the problem permanantly.

It will reduce only some of the crap in my pool... temporarily.

Other options?

You may be able to sue for nuisance. depends upon how much money you ant to spend and how aggressive you want to be. Perhaps start with a letter from an attorney to the HOA. If you would like to discuss this feel free to call my office
