Than 3 units are rented and have the records in the rent control very low even lower than they are current charging. this is NOT a simple problem, and you can NOT get a quick answer over the internet. Here is why:
You are spending several hundred thousand dollars on buying this building. You are risking all of that money and your credit too (if you take a mortgage). You must, MUST be sure that you will be able to get the rent income that you need, before you buy the building.

You are right to be considerate and cautious in creating such an agreement. You have to be concerned not only about NY/US laws, but of Costa Rican laws as well. You are probably best off consulting with either one lawyer who is admitted in Costa Rica and New York, or find one in each jurisdiction to pose these questions to so that you can make as air tight of an agreement as you can.

There are a couple of possibilities of what is wrong with your radio, but I doubt it needs any "adjustment":
First, if the Power button and Volume knob are separate, it is possible that your power button is function, but your volume knob is broken, if so, chances are you would have to take it to a TV/Appliance Repairman (if you can find one in this day and age) or just buy a new radio.
Second, its possible that in the back of the radio, on the wiring harness, the output wiring that goes from the radio receiver itself to the cars speakers has been cut, frayed, or become pinched in the dash, but the power cable from car's battery into the radio is still good, allowing the radio to turn on, but not allowing you to hear it.
Third, its possible that while the internal components of the radio that control the display and the associated input power are good, the components of the radio that process sound have gone bad, allowing for the radio to turn on, but not "work".
Finally, its possible that your vehicle is equipped with a stock amplifier that the speakers are wired directly to, and that it has gone bad, which is allowing the radio to turn on and produce sound, but not be heard.

A parenting plan is necessary in custody cases, but it is one small piece of a puzzle, and a pro se notarized agreement is highly unlikely to meet a judge's okay.
You didn't say if you were married or not, or if the child is legitimated.
At a minimum, any custody decision requires a parenting plan, agreement, petition, proper service, child support worksheets and financial affidavits. Also often needed is a child support addendum, certain county specific forms, inititation forms, disposition forms, report of divorce, etc.
Get a lawyer unless your child completely does not matter to you. It will be far cheaper than hiring one to fix your mess later.

Shaun, exactly what you need to do is going to depend on how your business is going to be run and where it will be located. There are some things though that pretty much all businesses need to look into though.
First is incorporating your business. You could be corporation or an LLC, but either way you will likely want to form a business entity to help protect yourself and your personal assets (house, car, etc.) from things that might happen with the business. Which type of entity you choose is a decision to have with a lawyer and accountant/CPA.
Second are things that you need to be in compliance with Ohio law, particularly if you have employees. If you are going to have employees, you will need to open an account with worker's compensation and unemployment. You will also have to "register" your employees with the state new hire database. Many of these can be accomplished online at the respective state agency's websites, but you may want to get an attorney on board to help.
Third are state licenses. Many businesses are licensed by the state. Doctors are licensed by the state Medical Board, bars need liquor licenses, retail business need vendor's licenses, etc. There probably aren't any state licenses for lawn care, but it is still something you should check out to be sure.
Finally are any local laws and ordinances. These can range from local business operations taxes to zoning ordinances. This is another area where it is good to have a lawyer to navigation through everything.
These are just a handful of "legal" things you will need to look into as you start up a business. You can do much of it yourself, but because there are so many different things to deal with can be very beneficial to hire a business lawyer to help.

Your uncle's actions, as you describe them, could constitute false imprisonment. As you say, he prevented you from leaving against your will. It will be for the jury to consider the credibility of the witnesses and whether or not to believe them. Unfortunately, given the circumstances it sounds like the only witness who will testify that he held you against your will is you. This is unfortunate because 1) there are witnesses who are obviously testifying against you and 2) the only way for you to likely tell your side of things is for you to testify. If you testify then you are going to be treated like any other witness. If you already spoke to the police during the incident then your side may likely be presented to the jury. Defendants have a right to remain silent and in general they should exercise that right.

You both have the same rights to remain in the family residence unless there are issues of Domestic Violence and one of you has been ordered to leave.
Concerning finances. You would need to file a request for spousal support with the court. Since this is a long term marriage you are entitled to spousal support based on the marital standard of living until you die, remarry, or further order of the court.
If you separate you need to file an Order to Show Cause to get spousal support right away as it will take time to get a court date.

Your question is somewhat confusing. Is the house in foreclosure? You should contact the lender and see if something can be worked out in which you guarantee on behalf of the estate a certain amount of money when you do sell the house [do not guarantee any payments or make any payment yourself]. you need to make up a detailed list of assets and liability, including income taxes for up 1/1/11 to 3/5/11. If the house without counting the mortgage and other assets are worth less than $100,000 you do not have to go through formal probate; talk to the creditor and see if they will withdraw any probate petition [any one with an interest in the estate can file for probate]. Borrow from the library the Nolo press books on trusts and estates so you have a better idea as to what you can and can not do

I'm not sure I agree with Mr. Stone. Tax documents cannot be required as evidence in most cases, but sometimes they can be. To sign a tax return is not equivalent to being a witness in a court case at all, much less a criminal case. They may refuse to answer specific questions if there is legitimate reason to believe that their answers could be used against them in a criminal prosecution, but otherwise they must testify when required to do so.

Because of a misunderstanding on my part it was not filed and returned to me because I did not include $10 filing fee. I received that notification on Thursday July 26, and the trial is Monday July 30th, therefore no time to postpone it, and, I currently live out of the country (in Puerto Rico). I spoke to clerks at the court house and was told about filing a 'motion to vacate' after judge's decision. Also spoke to small claims adviser and was told it was worth resubmitting it even though there was no time to postpone. I hired a courier and they did the filing for me on Friday the 27th. I explained that I had tried to file before, and that the reason I could not be there on trial date is because I live out of the country, have a son whom is a minor solely under my care that will begin school next week, I have no one to care for him, and also the travel expenses I would have to incur. I did this in the hope that the judge will have this information at trial and at least see the reasons why I am not there, and that I did try to postpone and do things right. I should mention that I am the Landlord, I do own a property in California, and when I was served (3 weeks prior to trial date), I was in CA just visiting for a few days. Obviously the trial has already occurred. Since you were served the court does have jurisdiction over you and will render a judgment, which you can appeal and have an attorney representing you on the appeal, if it is worth the legal expenses. I do not see what legal basis you have to file a motion to vacate, especially since the same factors preventing you from being present 7/30 will apply to later dates.

On November 21, 2011, I shipped 90 lbs of frozen food thanksgiving by UPS as a 2 day delivery. The package was delivered to their facility 45 minutes from my home at 12:35 a.m. on the 23rd but sat there until November 28, 2011 by which time it had spoiled.
On November 23rd I called UPS 3 times and was told that it was on the truck for delivery and would definitely be delivered by the end of the day. At 8 p.m. I called and was told they couldn't locate the package.
When the package was delivered not only had it been taken out of it original packaging and placed in a plastic bag inside of a too large box, it was incorrectly rearranged during repackaging. UPS is now telling me they do not cover claims for frozen food items, even though this was not told to me by the UPS store and I was not given anything to sign acknowledging that I wanted to ship in spite of this stipulation. I honestly did not know they had this policy. Their corporate office told me I should have read through their stipulations before I shipped the package, but I think it was their responsibility to make me aware of such a hidden stipulation.
It took me several weekends to prepare the food and I spent lots of money to purchase the items. Is there anything I can do to obtain justice?

No, but assuming you were on the initial loan you are still liable so it may or may not help to refinance at this point. There is no such thing as a "quick claims form" but why would you make the horrible move to give up ownership of property and still be liable for the whole debt? That would make no sense (though obviously we don't know what you have been ordered to do in the divorce). It seems that like many people a combination of poor planning in the divorce case, coupled with drops in property values, have left you in a bad place. While your new husband won't be liable for the debt, the reality is that the debts of one spouse almost always affect the entire household, so it is extremely important that you get good advice before you sign anything.

I would start doing a few things. I'd start looking for another place to live, I'd start sequestering the rent in a trust account of some sort (in other words, not paying it to the landlord), and I'd rent a storage locker and move out everything except a cup, a spoon and a mattress.

The lawyer told us he needed an indian lawyer to help gather statements and affidavits in India to prove the marriage legit and reffered us to one. He was very expensive but our US attorney said he was great and we should go with him. So we did. After the case was completed, the indian lawyer asked us to give the remaining $$ we owed him to the American lawyer because he (indian lawyer) owed him money for some travel. So we did. I later found out that the $$ we gave the American lawyer was actually a large refferal fee the indian lawyer paid the american lawyer for referring him the case (about 30% of the total fee we agreed to pay the indian lawyer). Is it legal or ethical for a lawyer to get that kind of a referral fee with out the client's knowledge? In fact, while misleading the client about the referral fee? It seems wrong to me. I know it would be very unethical in most other professional fields.

The only thing that she has was the actual deed from the people she purchased it from when the previous owner's bought it back in 1947 (which is in her possesion yet). She currently has a mortgage on the home and before we can re-finance it we want this straightened out. We did find the record of a (power A Sat) located in the archives at the courthouse concerning the purchase but it has no property shown. It seems that there was a power of attorney concerning the previous owners and his name is listed on this form as a grantee,but his name is also recorded as a grantor along with my mother-in-law and now deceased father-in-law names. So we would like to know exactly what this form means and how we can go about getting the deed recorded? Thank you.

If the check was post dated, the presumption that you knew the check was bad does not apply. The criminal charges should be dismissed by the Magisterial District Justice but that doesn't always happen. The question of the debt being that of a corporation may also be a good defense depending on your role in the corporation.

Where is he "saying" this? If is just to his friends, who cares? If he is suing you for back rent, you still owe the rent. If you abandoned the property, he is suing you, and the term of the lease has not yet expired, he would need to evict you to assure that he could re-rent the property.

The other day, I received a mail from a "auction delay service", and the mail indicated that my house is going to be auctioned on September 15th. Can this be true? I thought the trustee is required to send "notice of trustee sale" 20 days before the actual auction date. The mail looked little suspicious.
My question is ... how can I confirm the auction date without "notice of trustee sales". My original plan was to wait for the notice to come and then look for a rental place. Can I still wait for the notice to come before making any actions?

The notice of sale must be mailed 20 days before the auction. You know how the mail is..slow. Unfortunately, the law doesn't require that you receive the notice 20 days before the auction takes place.

You could file a small claims suit against him where the house and the work was located, alleging you were a handyman doing a job under $500, one filing each for the disposal, and one for the carpet. Then if you win, you could record that court judgment against that property, and you would be entitled to get paid before escrow closed. You are probably too late to timely file a mechanics lien against the property. You may be too late to get into small claims court and obtain a judgment before his escrow closes. But, just filing the case may prompt him to pay you, so try it.

In Virginia, there is a $5000 exemption for household goods, plus $1000 for wearing apparel. This means that for most people, household effects are completely exempt from execution. In addition, you have a $5000 once per lifetime exemption (more if there are dependents, if you are over 65, or if you are a disabled veteran) that can be used to protect assets - but use it carefully if at all so as not to use it up. You may want to consider filing bankruptcy if you don't have the ability to pay this debt, as the creditor can garnish your bank accounts and/or wages.

An electric car doesn't go very fast and are usually small, Gas powered cars have much more torque and speed. Some newer cars run on both so when they are going slow they run on electricity but when they are going fast they run on gas. These are not electric cars though as the fuel used is gas to create the electric power.
To answer your question, gas cars are far better because they can go further then 20 miles and are legal on our roads. There are no legal electric cars commercially built.and do not exist.

Yes, the witness can and must go to court. Failure to comply with a body attachment can result in being arrested and jailed until the person complies. That does not mean that the person cannot tell the prosecutor that they do not want to testify and that if they have to testify their testimony will not be favorable. (This will go a long way toward convincing the prosecutor to back off)
This answer presumes that the witness was personally served, if the witness was not personally served then the body attachment could be attacked.

It won't help but the bigger issue is the impact on the child should you relocate. If challenged by non custodial parent, the questions will focus on what is in the best interest of the child with "stability" and "extended family" connections being near the top of the list. Child's age would be considered as it could be thought more difficult for an older child with established connections to relocate than it would for a younger child, especially one who is not yet in school. I suggest you find a family law lawyer you are comfortable with and make an appointment for a consultation. Then you can get into more of the details of your situation and get a more informed analysis.

There isn't anyone who has ever filed a restraining order or even complained to the Sheriffs Office about her. She had a bail hearing last Thursday and nothing came about because it was postponed until next Thursday, 4/19/2013. Not only is the bail excessive at $100000 for a person who at the most been givin a 72 hr evaluation at the mental health ward. But can they hold her on felony Stalking if there is no one that was being stalked or even harassed? Or is this a case of abused power by the Sheriff/ DA? My friend is dear to me and I am concerned.

The lack of a police report or a restraining order does not mean "there is no one that was being stalked or even harassed". It only means no one has complained about it in those particular ways.
You seem to believe that stalking may only be charged if a restraining order is in place or if the victim has complained to the sheriff. That is not true. The authorities can file charges even when they learn of a likely crime on their own. They do not need the victim's cooperation. In fact, they can prosecute even if the victim is adamantly against it.
Bringing charges without the victim's involvement is not an abuse of power. It is something prosecutors have to do from time to time. This may be one of those times.
Your friend needs a lawyer ASAP.

Yes ,it does damage after quite a few years. About 6 years ago I bought this GOGGOMOBIL T700 1959 MODEL , and it was in storage for about 20 years. The tank was still there,but when I took it out ,there wasnt any petrol left. there was 2 buckets of dry sediment and rubbish left .After a good cleanup,the bottom half of the tank had quite a few tiny holes which where beyond repair. Infact I had to make another tank inside the original so when you look from underneath ,you see the original tank.
I have another old car,a Hillman Minx 1946,but when I cleaned the tank,it was still solid and still using it.

= 76,000 in available equity that should go to creditors.
In Ch 13 they would not need to sell the house, but their excess income above a court approved budget for 3 years would be applied to their unsecured debt - and they keep the house.

Usually you do just a certificate of mailing by regular mail or a receipt of copy delivery by a messenger service. No need for a process server as the address should already be part of the court record.
