My son is 9 years old. He has lived with me since he was born. His father signed his birth certificate, but he left when my son was 3 years old. Do I have sole custody of my child?
Answer
In Ohio, if you were not married, any child from you body is in your sole custody until the father establishes his rights through a proceeding in the juvenile court. Signing the birth certificate is some evidence that the father can point to in court to establish his rights, but until he does get a court order naming him the father, he does not have custody of the children.
