When dealing with a workmans comp lawsuit if you are considered permanently partially disabled and surgery is not an option what happens? If a settlement is reached and the case is over can the former employer appeal?



Answer

1.) It is not a lawsuit, it is a claim.

2.) ALL Injured worker' are permanently partially disabled.

3.) Once the settlement is approved by any Commission official, the case is over.

4.) If the case is tried rather than being settled, the employer can appeal the case at least three times: 1: Review at the Commission; 2.) Removal to the Circuit Court; 3.) Appeal in the Illinois Court of Appeals.
