I am renting a condo. The application and the check deposit for the first month rent have been submitted. The check deposit has been cashed out.

Now, the landlord wants to rent the condo to another person who offers $100 more than what I pay. She is saying I either sign a 24 months lease or pay for $50 in addition to what the other applicant is willing to pay for.

Is this right since the landlord has already cashed out my check and had my applicaiton in hand?

Is there a valid lease(contract) or not (whether written or oral) would seem to be the major legal issue in the situation described, and, if not, then the landlord is free to do what you've described with impunity, but, if, however, there is such a lease, then you could sue her for whatever damages you

may have incurred arising from her alleged violation of said lease.
