Question

I bought a condo with my partner 5 years ago. I'm moving out of state to be with family. We have no mortgage and he is buying me out. Once I sign the deed over to him and he gives me a check how can I protect myself so that he doesn't stop payment on the check? I don't trust him as he is very upset about my moving out.

Answer

My advice would be to retain an attorney to assist you in drafting some type of Purchase & Sale Agreement or Settlement Agreement containing the terms of your agreement to buyout your partner. If you had other accounts and property together, it would be a very good idea to form an agreement that deals with everything all at once - - almost a separation agreement for non-married partners.
