I'm not clear on what you signed. The important event would be the plea hearing in front of the judge: you either plead guilty or no contest, or did not. Some courts have defendants sign an advice of rights document but that's just doing something on paper so the judge doesn't have to verbalize the same information to the defendant (like: you're giving up your right to a trial by jury, you're giving up your right to confront witnesses, etc.). Short of that, "signing a plea agreement" does not cross a line that you can't retreat to. But, if you actually entered a guilty or no contest plea, then there may be legal barriers to you withdrawing your plea. The court rules say that a judge should liberally allow people to withdraw pleas before sentencing, especially if they are doing so because they claim they are not actually guilty; this is not an absolute rule, though, and there are some situations where judges would not or should not allow the plea to be withdrawn (like if it's being done because the defendant got a preview of the likely sentence and is trying to withdraw the plea because they don't like that sentence). It's even tougher to withdraw a plea after the sentencing hearing is over, and if that has happened you need to talk to a defense attorney personally about your options and whether your reasons justify such a request.

In a petition for a writ of mandamus against a local housing authority, the attorney filed a demur saying that the petitioner lacks jurisdiction basically saying it's a federal program, so what if it is administered by a local agency. Well they were overruled because well they were full of BS. Now a second petition has been filed with almost identical circumstances and they have sent out the exact same demur that they were over-ruled on. I am the third similar type petition and I am awaiting their response which will most likely be that same demur. I'm representing myself and I was just wondering if in the event that I receive that same demur saying I lack jurisdiction, could I respond in opposition to it by mentioning how they have been over-ruled on this issue as recently as a month prior?

It just seems like a lazy tactic by the county counselor to further delay the actual hearing on the writ, and why not, it does hurt them to stall and delay...They also pulled this BS with the two previous cases and I guess I should expect the same, but they file their response with the court and then wait until almost 30 days go by before serving the petitioner the response barely leaving anytime before the hearing on the demur takes place. Is that just typical attorney antics or are they acting unethically?

After reading your question twice, I am still a bit uncertain who is the plaintiff, the defendant, the demurring party, or who prevailed, and why, in each of the preceding cases. Thus, I don't think I could give you a for-sure answer or explanation without reading the complaint, the demurrer, and the court's ruling on the demurrer.

As a general rule, a trial court should reach the same conclusion on a demurrer or any other question of law each time it is presented. Of course, the judge or court can change its tune if (1) it decides it was wrong the first time, or (2) there are even subtle but legally-significant differences in the facts.

The county attorney in filing the successive demurrers may genuinely be trying to change the court's mind, or to preserve an issue for appeal; or, on the other hand, may just be trying to make it harder for the plaintiff/petitioners to prevail. Early in my career, I was an expert witness for an attorney who had a pre-prepared 400-page demurrer that he would file every few years in a particular type of case (blocking of grade crossings by railroad trains; he was defending the railroad company). He was really proud of his demurrer. I'm sure the judges that had to read it felt otherwise.

You and your family are finding out the hard way about so-called tort reform. What your lawyer is referring to is health insurance subrogation, a device being used by health insurers to essentially steal money from their own insureds. This was made possible in large part by the passage of the ERISA statute by Congress during the Nixon Administration years ago but which really only became implemented in the last 10 years or so. Hidden in the language of of the health insurance policy is a clause termed either "subrogation" or "right of reimbursement" which states that the health insurer has the right to recover from its own insured the amount it paid for medical expenses if the insured got those treatments as a result of an injury that was the fault of someone else and the insured (your daughter) sues and gets a verdict or settlement from that person and/or that person's liability insurance carrier. There have been some exceptions carved out of this by the courts but they are so complicated that it takes a lawyer who really knows about this to navigate it. There are many in the legal profession who believe that this "subrogation" is not really about the health insurer getting back money at all. Rather it is about wrecking the civil justice system so that the injured person, faced with the prospect of recovering effectively nothing or very little, will drop the idea of making a liability claim in the first place. This is another insurance industry scheme adopted by our government expressly against the best interests of the people because of lobbyists and one of the political parties that is wholly owned by special interest groups, particularly the insurance industry (I'll leave it to you to figure out which one that is). As long as people keep voting for that party because of artificially manufactured "wedge issues" like gay marriage they can keep cheating the American people with scams like this for the benefit of the fatcats. People like you find out about this one person at a time when something bad happens to you or a family member. You need to read up on this, tell all your friends about it and vote accordingly.

She said she did it provided a receipt with the correct amounts, and I thought I was done. I found out one of my credit cards was way over the limit, come to find out that the receipts they gave me were false and they actually charged things incorrectly as well. They did not put enough on one credit card, and put too much on the other. I did not receive a receipt for what was actually charged nor did I sign or give permission for doing that over charge on the one credit card. Did they just apply the wrong tickets to the wrong cards, or did they charge additional items you did not receive to your credit cards? The first situation is probably just a mistake, and you should be able to correct it with a letter to the airline showing the mistake, and asking for a refund of the overcharge penalty ($35?). If the employee stole from you by charging items to your card that you did not receive, then report it to the airling, the credit card company and the police.

So they can pay you minimum wage for a training, and then raise it back to your regular rate. It's a dirty trick, but legal. The only thing that is illegal in that regard is trying to retroactively pay less than the agreed rate for work already done. Also, though implied in his answer, it should be stated expressly that if you are an exempt employee they can definitely make you attend without additional pay or with just a stipend.

I told him to send me an email stating what we agreed on and I would give the info then. He stated he would call me the next day to let me know when the email was sent. I have never heard back from him. Now I am very worried that either they are going to do a garnishment or they were scammers that had all my credit information.

I would need to know more about the reason for the court date. If it deals in any way with discovery or any disputed matter, then it would be malpractice for the attorney to allow his client to get the settlement agreement in place before then. If there is a dispute as to the terms of the agreement, then it should be addressed to the court. Insisting on acting on the record is not, in and of itself, a violation of any professional standard.

Your wife's attorney can only represent one of you in the divorce proceeding. if you are representing yourself, then he will take steps to avoid the appearance of giving you legal advice... generally, this means communicating with you in writing rather than informally. Court rules do not require documents or information to be transmitted informally (fax and phone) although this is common practice between attorneys; the rules speak only to mailing and in hand service.

If discovery deadlines are being ignored, you have the option under the rules to seek to compel. If your wife's attorney is violating any ethical rules, you have the option of presenting this to the court. If he is simply advocating his client's position (ie setting a court date for a reason) then there is not a legal issue; if however, the court dates are being set for no reason, the judge handling the matter will address this issue.

This is not really a conflict of interest, but it is shocking that the attorney is not cooperating with you. Keep a paper trail and tell the judge what is going on at the pre-trial.

You can try to do this yourself, but the filing fee alone is 275 to 375 depending on the filing method, which is not refundable. So you want to make sure you do it right the first time. It can be a very complicated thing, and I personally would try to find a lawyer who would this for a reasonable price which could start at 500.

Of course, a federal registration through the USPTO is much stronger, as it gives presumptive rights in every state. The facts you describe are problematic on several levels and may give rise to several claims, including a claim for wrongful retention of compensation that generally includes both the withheld monies and additional damages. If an employer doesn't pay the employer's share of premiums (besides not forwarding what it collected from the employee) it may violate Maryland's wage and hour law.

Maybe. There are arguments that can be made either way. What really matters most is whether this company (biologie) considers it too close. Would you? If so, they are free to oppose or petition to cancel even if the USPTO approves your application. A name like Biologix will be saturated so you really have to clear this well and it is not a DIY kind of project. Ultimately only your own trademark lawyer can offer the kind of specific and actionable advice you are seeking on the mark.

Further, whenever you endeavor into investing in a trademark it is very important that you conduct the proper clearance due diligence upfront and before you submit an application to the USPTO. An example I often use is that the name "Purple Passion" could be trademarked separately, without conflict, for lipstick, house paint and Zinfandel. I suggest having your intellectual-property lawyer look at which product categories "Biologie" is registered under, and whether "Biologix" would be in a different category of product or service. A revocable real estate trust could have many purposes. I assume that you have created the trust to shelter your home from the high cost of medical care. If so, it focuses on the home alone. I think that most people should be concerned with quality of life and enjoyment of life as well as the monetary issues.

I suggest that you meet with a lawyer who can learn the specifics of your situation and give legal advise to you.

The BEST way to give your daughter these items is to do it BEFORE you die as a gift. Wouldn't it be nice to see the expression on your daughter's face when she receives these items? If you don't want to give her these things until your death, I STRONGLY recommend that you have a will prepared by a lawyer and property executed (signed). It will not cost you very much money given that you don't have a lot of property and will ensure that your wishes about where your property goes upon your death are respected. Having a will created will also allow you to direct how you would like to be buried (or cremated or otherwise), where, etc.

My step mother filed for divorce in 2010 in California. An ATROS was placed on all assets. She placed a joinder on my father's 401k, but my father didn't think it was necessary to place a joinder on her 401k. My stepmom was receiving alimony. My father continued to work to provide medical insurance to her as shortly after she moved out she was diagnosed with pancreatic cancer. In December 2012, unbeknownst to my father, she violated the ATROS and cashed in an IRA and also transferred her 401k and converted it to an IRA. Her best friend's husband was the financial advisor. The paperwork was filled out stating she was divorced and single and the transfer went through. She named her brother and boyfriend as co-beneficiaries. She passed away in July of 2013 and within 2 weeks the beneficiaries each received their inheritance. Through much investigation my father was able to ascertain information related to this transfer but it was too late. His probate attorney sent a letter to the bank's vice president and it was forwarded to the banks attorney. The attorney for the bank determined that the paper work filed was sufficient for the transfer and said they are not responsible for the actions of their employees. This is a large sum of money and my father says he doesn't want to fight it because of the expense and he just wants closure. Any advise you can give would be greatly appreciated. The releasing nor receiving financial institutions did not ask for proof of this divorce (obviously the best friend's husband has violated his ethical responsibility and possibly some laws along the way) and accepted a 2010 tax return that she had indicated her filing status as "single" as sufficient proof. My father is clearly listed as "spouse" on her death certificate.

We were not told the truth--grew up told that father was brother and mom was sister-in-law. Only reason we ever found out was from HER family--at a wedding, no less...
