leased a restaurant 4 years ago. The original owner sold the property and the new owner on reviewing the contract realized the commercial leasing contract was not valid since it was a generic leasing contract. The new owner now wish increase the rent. The original contract was reviewed by my attorney. What rights do i have? Also, the owner continues to change his mind on the rent. One months he states it's fine and then, the next month he's threatens to increase it.
Answer
As a Franchise Attorney I can say the following. Without reviewing the lease you signed, its not possible to say. For example, is it a month to month or a four-year lease with stated rental. Lessors must adhere to the rent specified in the lease if it's not just a month to month lease. Consult with a good business or franchise attorney in your area for specific advice.
