Hi I did a photo shoot, me as the photographer, and my subject used my photo to promote his local TV show and has told me through email that he knows he wasn't supposed to use my photo but still uses it for advertising. Do I sue Him or the magazine TV show he works for? Do I have a case? I have ALL the proof for my case.

You have a case for copyright infringement. You need to inform both him and the show that they are not to use the photo unless they pay you or give you credit so people can get to know who you are and how to contact you - if that's what you want out of it.
