Question

why did a maryland district deny me my right to a preliminary hearing? I was scheduled a preliminary hearing 25 days after my arrest. When i appeared they told me it was postponed and i signed a document that stated postponed and i would be notified of a new trial/hearing date. It also said reason for postponement was:REASON; NOT ELIG SET FOR TRIAL; 9VO. I just received a summons for a trial date 90 days from now without being able to have my right of a preliminary hearing

Answer

It sounds like they mistakenly set a preliminary hearing on a non-felony or a district-court tryable felony case. That would make you ineligible for a preliminary hearing. If you'd like to contact me with the case number and more details, I'd be happy to check.

Answer

Perhpas the case involves misdemenor charges, felony theft, or the grand jury has returned an indictment.
