Child is 18 yrs old and graduated from Highschool this month. Do i have to continue to pay child support if he attends college?
Answer
Yes. Missouri law calls for support to continue during the first several years of college. You may be able to get the amount changed.
Good luck
Answer
Read the child support statute. I'm sure that it was largely written by non-lawyers. Generally speaking, the statute says that child support stops when the child reaches 18. BUT the FSD takes the position that they will continue to collect the child support even affter the child turns 18 on the belief that the child will enroll for a full course load in college by Oct 1 following graduation from high school, maintain suffiicient grades, make all tof the required reports to the parent paying child support in a timely fashion and therby force the obligation to pay child support to contiue until the child is twenty-one or graduates from college whichever occurs first. If the child fails to comply with all of the requirements of the statute, you should immediately file a Motion to Terminate your child support obligation. You can hire an attorney to help you, or you can try to get this done representing yourself.
