Question

If you are in a situation where you need to serve a response on the opposing party, and do not do so what will happen?

IE. Child custody case, plaintiff serves all parties with motion but defendant serves responses, witness and exhibit lists only to clerk and no one else



Answer

If the parties are not properly served and it is brought to the judge's attention, the judge will either not hear the motion or will put it over so that the other side has time to respond.
