Good morning. I need to know if I can withdraw my 5yr old from Kindergarten (NY state) and have her re-enter school the following fall. She has been having difficulty in the classroom, & spends more time in the office for disciplinary referrals for refusing to work, disrupting others & otherwise being non-compliant. She has already been assessed at a first grade level & despite disciplinary problems has managed to produce academically. She has become more withdrawn from school as the yr. progresses & I don't believe the school has utilized effective strategies to support her mental health needs in the classroom. What are my rights & options? Please & thank you

Have you considered having the School Based Support Team evaluate your child. You are entitled to have your child evaluated.

In any event, Kindergarten is not mandatory in NY. You may withdraw her if you desire.

I have a 16 year old that no longer wants to live with her Father due to the circumstances and of which who has primary physical. Do we have to go to court to change custody? If so, is there a way to do it ourselves with out representation or at a minimal fee?

You could change custody via stipulation and order. No court appearance is required so long as the paperwork was properly prepared and filed.

I had a aligation of abuse agaist me by a very upset teenager. The alligation was unfounded after an investigation, now the local small town police are showing up at my childrens school 3 weeks after the incident from which they were originally called and ignored and when my husband confronted the police officer he informed us "that he doesnt need our permission to talk to our children". We live in a very small town and now with the attention at the school numerous rumors are circulating. Is it legal for the police to show up at the school and pull my children out of class and interview them over something thats already been resolved by the state? My 16 year old was pulled out of Algebra and missed m ost of the lesson and had to stay after school 2 days to make up what she missed.

You should start local and work your way up. Call the Police Captain, then the Police Commission or commissioner, then the Sheriff. the KBI and the Attorney general's office. You might have to involve the FBI or the media. But, I reccomend that you hire legal counsel somewhere early in the process, to advise you step by step.

Will the credit card company or the banks report to the police and ask federal government to contact Taiwan government??

Whether there will be police activity in the situation depends on if there was criminal conduct such as fraud in obtaining the credit. If it is simply a matter of a loss job, etc., which resulted in the inability to pay the bill, then it is a civil matter and the credit card company would have to sue you to get a court order for a judgment.

I am unaware of a request to another government for help in obtaining repayment of a debt. If you are indicted on felony theft or fraud case, then the U.S. government could seek extradition of you to the U.S. for prosecution.
