Question

My son will be going to college in September 2014. Now, I pay child support and in my divorce agreement I will, if able to, help finance his education. Now, if he lives at school do I still need to give the child support money to his father? I would rather give a portion directly to my son for food, etc. and another portion to pay for his tuition. Can this be done since he won't be living at home with his father?

Answer

No, child support needs to be paid directly to the custodial parent. However, since you now will be paying college tuition for him, you may have an argument to have your child support reduced.

Answer

Child support must be payed directly to the parent. However, because you will now be paying college expenses, the support amount may need to be modified so you're not overpaying. You should see an attorney for a consultation.
