I went to PF Chang's and ordered the dessert. When they served it, the glass dish had broken off and I had a piece of glass in my mouth. I bite down to discover the glass. I have the insurance claim but with work I haven't gone to the dentist. They want me to pay for it and they will look over the bill to reimburse me. The are now giving me until 12/2 to go to the dentist or the will close the claim. What if I swollen some? Can I sue for damages? [email protected]/* */ 909-578-4626

Since a piece of glass is not a foreign body you could expect might be in a food plate, they are negligent and have to pay for your damages. They can make you spend the money for the medical treatment first; there closing out their file has nothing to do with their liability for all of your damages. You have two years to file suit. Do not settle until you know what your overall injuries. Check your stool for blood when yo go to the bathroom; if you see none, then the glass has probably harmlessly passed through your body.

The restaurant is not obligated to pay for your dentist up front. You will have to go out of pocket for at least one visit to find out what is wrong and how much it will cost to fix. If they still won't pay and you don't have the money, you will have to sue them. If the total dentist bill is less than $7500, you will have to sue in small claims. You may find a dentist who will examine you for no up front cost in exchange for a lien against any recovery you receive. Call around your area and see who might be willing to do this. Just a creative suggestion in the event the up front cost is preventing you from getting the help you need.
