In california I've heard that a court appointed psych is protected "immunity" from being sued in family court during or as a result of a custody situation. My question is if a private "Therapist" is requested to continue as a therapist for a child during a custody proceeding, not as an evaluator but as a private therapist, is this "therapist" protected "immunity" as well or not.
Answer
People are protected from being sued for what they say in court. If they are treating someone and act in a negligent fashion, they can be sued for malpractice, as treatment is entirely separate from their role as a witness.
