i have a four year old who hasnt seen her biological father since she was 8 months old. And my husband is on her birth certificate, so what rights does her biological father have as far as gettin custody

If you were married at the time of conception, unless separated (meaning living apart and not having sex) for 10 months or more, then the biological parent does not have standing to seek custody or other parental rights. In other words, if you were married and living as husband and wife when you concieved your child, you husband is the father in the eyes of the law.
