If this is a California marriage and it's a checking account containing money earned during the marriage, she is entitled to 50%

Under California law, the spouses owe a fiduciary duty of care and proper management of the community assets and liabilities. You have a right to demand an acccounting from your husband of those funds if they are totally in your husband's control as well as a right to 1/2 of any money earned during the marriage.
