I am filling out a rental application and one of the questions on there is have you ever been convicted of a crime involving fraud or dishonesty? I was convicted of retail fraud in 2009 is that considered fraud? How would i answer that question?

Unless you had that plea taken under advisement or some other special statute it is a conviction and recognized as a crime involving fraud. You can move to set it aside after 5 years however. Contact me at kliszlaw.com to discuss. Tim Klisz
